They could file suit and obtain a judgment, if they wanted to. However, like Shazzers said, they probably will not be successful in garnishing any unemployment income you have.
How much is the bounced check for? If it's only a couple hundred dollars, they probably won't sue -- it's not economical for them to throw another couple hundred out there and risk losing even more, only to collect a couple hundred.

i dont believe that they can garnish unemployment, i have heard that before but then again things may have changed. but i dont think they can anyway. And frankly i would have to agree with the above post if its not a huge dollar amount, i wouldnt be too concerned considering the mass amount of debt that are in the courts right now. but look at it this way worst case scenerio they take you to court and you get a judgement on you. show up in court proving you cant financially pay it (provide your proof like bills, income, etc) and the judge will issue a fair way of dealing with it. weather that be a lein on your home, a payment plan if he feels you can afford it or whatever but it would be fair.
