Accountable for Mothers Credit Card?

My mother passed away three yearsa go, but about 1 1/2 years before she did she had me take her to a bank and she opened a checking acct which she had my name put on in case she was hospitalized I could access her funds etc... She applied for a credit card with the same bank, but when she died she left a debt of $8,000plus.

Wells Fargo was the bank, and though we provided them with her death certificate and all they said I was now responsible for the credit card she had. (Which btw my brohter was of much help racking it up to that amount I found out later). So for three years I have had them tryig to collect from me. They even took her name off the acct and left mine on it. I wasnt even aware she had the card until after she passed away.

I went to the local branch where she had her acct and I spoke with the manager and asked for proof of my signature for the credit card. He said that they didnt have that information in their offices etc....I got a lot of run aorund.....

My brother asked them if they could put the card in his name and he'd pay it off etc...since it was mostly his debt. They did not go for this and just kept harassing me.

I was recently hospitalized and had complications from a surgery when I was served with court papers. I was unable to even get out of bed for almost a month and my brother had said he would find out from a lawyer what to do. But he forgot to get this done and I no longer had the paperwork he did.

What a mess. Now I have a judgement against me for 14K.

Whatc an I do now, obviosuly on my own, not relying on my brother etc..
I am a disabled mom and definatly not in good health, nor can I afford an attorney.

That doesn't make a lot of sense. Just because you happened to be on her checking account, doesn't make you responsible for the credit card. Here's my scenario: I'm on my dad's checking account, and his mortgage is at the same bank == that doesn't make me responsible for his mortgage if he defaults.

When was the judgment entered? If there's still time, hopefully you can try to vacate that judgment and get it back to trial.

I don't understand any of it either. After she passed they sent me a card in my name for her account. I refused it and cut upt he card and told them it was not my acct. They said at the time - well your mother had a card iny our name also.........ok so my mother had a card ordered a card in my name? Yet, I never received said card, nor would they show me any proff of signature for the acct by me.

I asked them for proof so many times, to no avail. I have no idea how to have the judgement against me changed. And my brother is leaving town for the winter (won't be back until spring sometime). Basically I feel Im being screwed. Sorry to be blunt. I feel bailed on, and my health is not good at all. I am unable to leave my home most of the time because of my health and I have no way of securing a lawyer.

The nervous breakdown is coming, I know it.
