You will need to contact the court where the judgement was rendered and dispute it based on lack of service. Did you live in california at one point?
Yes I was living in California, moved to Idaho last july 2008.
Yes I was living in California, moved to Idaho last july 2008. The paperwork from the wage garnish is dated "judgement entered 4/29/2009". The earnings withholding order is from California, I work for an International airline, which is head quartered in Chicago, they also have my employer with a "Sacramento, CA" address. So many things are not right with this, any advice? Thank you Joseph

They obiviously falsified the proof of service (not surpised) or served someone at your old address and told them to tell you.... You used to be able to look at court docs online for free in some counties, now some counties charge a fee. Best bet is to go to the Superior Court of California website, find your county and then search the court records online for your name (do a master name search). If you can view docs online free still, awesome! If not, call the court clerk and see what you need to do to get a copy of the documents. You will then need to file a Notice of Motion to set Aside/Vacate Judgment. You might be alble to talk wth the folks at a low income attorney clinic in the county to help you out.... hope that helps a bit....

Thank you so much. Went on to court website and cannot find my name or the case number they have on the paperwork (to my employer). Plus I looked up the address that they have for my employer ( in california) and its a home morgage companies address. This whole thing is getting stranger by the minute here. It is not obvious falsified....he could have been served by mail at the old address or someone else at the address was served. Yup you will probably get the order vacated but they may immediately turn around and sue you again in Idaho.

Did you live in more than one county while in California or did you use a different name ever? check it all and check the court where you live now... they would have had to filed a Application for Entry of Judgment on Sister-State Judgment and a Notice of Entry of Judgment on Sister-State Judgment.
They MAY not have falsified it, maybe just stretched the truth a bit..... and served someone underage or not within the legal format of subsitute serivce....

Yeah, if they violated the proof of service, now they are liable to YOU!! Check the court rules in your state, and prepare your defenses.. More than likely your case will be dismissed on a technicality.

Thank you both for your interest. I did indeed look in the right county in Ca, and yes it was only the 1 county I lived in and I also tried my current county.
