checksmart trying to collect from 2002
Date: Mon, 11/09/2009 - 13:11
I was trying to find information and came upon this site and thought I would join since everyone seemed really helpful :)
so now my situation:
I got a call from a Senior Litigator at Financial Liability Reporting Services saying that I was going to be sued for not paying on a loan from Checksmart that I took out in 2002. She asked me if I remembered this and I didn't at first, I know I used to use them, but always paid them back.
I live in Ohio and it was a storefront that I used (because I never used internet based ones.) I don't remember what she said I owed because I was trying to get information from her that she didn't have and I was getting frusterated (it was around $300 I think). The only situation I can think of was a Checksmart that was next door to where I was working at the time, when it came time for the payment to come out of my account the check bounced, I then had the manager of that store harassing me at my work place for 2 weeks until I got paid again. I called their corporate office and explained what was going on and that I intended to pay. They told me there was another cash advance place nearby that was owned by the same company that would accept a cash payment so I wouldn't have to encounter this rude woman, so that's what I did.
I don't know if that is the situation they're referring to, but I don't have any proof, I paid in cash, and it was so long ago, I don't have any of the documentation...I don't know what to do. I know I paid it, and I don't want to pay them again, but I don't want to go to court because I have no proof that I paid it (and apparently neither do they). Can they even go after me for it after so long?
any advice would be greatly appreciated!!!
Thank you so much!

The statute of limitations for Ohio for a Written or oral accoun
The statute of limitations for Ohio for a Written or oral account is 6 years, so, tell them they are out of luck! If they DO try to take you to court, all you would need to do is file a motion to dismiss with prejudice because the statute of limitations ran out.
ok thank you! I was trying to look up the statute of limitations
ok thank you! I was trying to look up the statute of limitations but I wasn't sure what that kind of agreement fell under...
