Sued by Blatt, Hasenmiller, Leibsker & Moore
Date: Tue, 11/10/2009 - 09:59
Yesterday on 9th, I received "Notice of Claim" in mail and it states that I am being sued by Blatt, Hasenmiller, Leibsker & Moore LLC for Capital One debt from 2007 in the amount of $1350.
It was apparently filed back in September, but the hearing date is on 12th, this Thursday! Here is my situation - I do admit that this debt is valid and all and I would pay it but I can only pay it in 4 months perhaps. So, I am thinking if I should call these people and try to settle with them.
However, is there any hope that they would actually do that, 2 days before the hearing? I wouldn't want to call them and mess something up. Is there a chance that they would accept something like this out of court?
Thanks.

Give them a call you have nothing to lose. I just handled a cap 1 case that was post judgment and they accepted a roughly 50% settlement. Case was old from 2007 judgment...

Hey, I settled for $150 a month. They can't cancel the hearing, there will be a judgment but I am now waiting for the contract in mail.
I can handle $150! :)

Since this has been a fairly positive thread, I'd like to add to it. I've been sued by BHLM (was served papers this weekend) as well and upon reading up on them on the internet (nothing positive, mind you), I was terrified of dealing with them and what would become of the lawsuit. I decided to call them this morning at 8:30 to see if we can settle this debt that I DO rightfully owe (to Dell).
The man I spoke to (at the Pennsylvania office) was extremely nice and cooperative and accomodating. He didn't boss me around or tell me how it was going to go down on his terms. I was obviously nervous talking to him because I was worried he would give me a hard time, plus I've never been sued before. I was like "I don't know how to go about this because I've never been through this before, so just tell me how to settle this or what the procedures are..." and he was like "No, no. You tell me what YOU can afford and what YOU want to do to satisfy this debt. We'll work it out."
So, needless to say, I also settled (on my own terms and based on my budget) $150 a month (I'm sure I could have done less, but I want to pay this off sooner than later) and he asked me when I would like to start paying it monthly and at what point in the month. Easy as pie and the man was super nice!
I'm not sure how other BHLM offices are, but the one in Pennsylvania was easy to deal with. So, for anyone who has to deal with them and comes across this thread and RIGHTFULLY owes a valid debt, don't get worked up and defensive and try to beat it. If it's valid and you know you owe it... pay it. If you can't afford to pay it, call the collection agency/lawyer (if you are sued), tell them your situation and work it out maturely.

As a suggestion, if you're going to follow this path it would be better to make an offer to settle and get a settlement agreement instead of essentially conceding to a judgment. Why? Because a settlement agreement basically states that the matter will be settled via payments over a period of time, and if and unless a payment is missed, then and only then would a judgment enter for the remaining balance, less payments...I believe as well you could also have them agree to clean up your CR if all payments are made...Way better than just signing or agreeing to a consent judgment...

And Whenever possible: settle these BEFORE they go to court. In my State, Missouri, we look on casenet on the web and can see all court matters under our name....forever. My stupid ex-wife made me look bad enough with the protective orders when I was running away from her as fast as I could....so I sure don't need a bunch of defaulted note cases out there.
