Does anyone know the PA laws?

  • I have been trying to find the updated info on here but am lost. The link provided in the sticky listing all the laws doesn't appear to be valid any longer.

  • Whether they are legal or not in PA is an issue you probably will need to fight with the payday lenders yourself for the time being. Although the Department of Banking won the battle over their new interpretation of the Consumer Discount Company Act in the Commonwealth Court (there was no new legislation or even formal rulemaking, which seems to be the main issue in the case), CashNetUSA has appealed the case to the state supreme court. Traditionally, the Department of Banking refrains from starting enforcement actions under new rules or laws until the courts are done chewing on them. (Like they did with check cashers and mortgage lenders when new laws were passed over the past dozen or so years) No reason to think they would be any more aggressive when, technically, there isn't even a new law or regulation, just a new policy based on a very old (passed in 1915) law.

    This doesn't mean you can't win the fight. Not by any stretch. I'm just saying you need to familiarize yourself with the laws and be prepared to argue it yourself. Once the Supreme Court is done with the case, assuming the Department wins, I'm sure they will be much more helpful. It just doesn't seem to be the case yet.
