need help with collection agency threats

I had taken a cash in advance online in 2005. The company started to take payment from my account on dates not agreed apon and funds were not there. I ended up not able to pay off the cash advance becuase I kept getting negative activity in my checking account with Washington Mutual. I ended up in a situation where I owed the bank more money just from fee's alone and there for when I payment was due the money was so negative I could not cover the full payment. I did try to resolve it but both companies were treating me like I was a criminal and pretty much scared me away and got me upset everytime just by the way they talk to me. Now, a collection agancy recently called me and told me to pay within the next 48 hours or ELSE. Yes, they told me things like I'll remember their names when I'm in court paying ALL court fee's plus some. They scared me and I felt helpless because I can't pay the full amount they ask. Originally loan was for $200. Now I owe almost $800 and collection agency said if I pay $380 today they will settle and not allow me to get sued. I explained I have no money at that time. They just told me good luck and have fun in court then hung up. I still am a little scared becuase I don't know what is next. Am I going to get sued by someone and is this a quick action that I am going to get served any day? It's not that I refuse to pay but, they would not give me a realistic payment plan. In this tough time, I don't know too many people that can hand out $400 in an instant. If I do get sued, am I able to talk to someone who will be on my side instead of the attack mode and let me figure out a payment plan? Does anyone have advise or do I actually have time to gather money before I guess I go to court? I need to relieve stress because this collection agency out of nowhere called and scared the heck out of me.


absolutely great advice if you get back to us! honestly they are not allowed to threaten you this way its harrassment. and honestly dont be afraid of getting sued in the event you end up in court, they will usually set you up on a payment plan according to what you prove you can afford. and if you show you cant afford anything, they will put a lein on your home. there are many possible outcomes. dont be scared and read up there are great posts on how to deal with harrassing creditors
