Phone calls after sending cease communication?

This is what I wrote in a validation letter to a CA, cut and paste:

"I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, family members, friends, neighbors, or random calls to persons listed in the telephone directory of my specific area who share my last name for the purpose of contacting me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. At this time all such mentioned attempts are being documented and I will be forced to report violations and will bring legal action. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS."

Yesterday they contacted my parents house and left a message on the answering machine... I did recieve a validation letter and acknowledgement. I am highly irritated that they are still calling my family, and getting the phone numbers off google.

What are my options?


There is no provision in the FDCPA for a "limited C&D". It is an all or nothing statute and they do not have to abide by a limitaion of contact. They can consider it a full cease comm or ignore it completely. There's not much you can do in regards to that. Do they have your correct contact information? If so, they have no business calling your family. That would be a violation as the only intent there is to harrass.

For a full cease comm they are allowed to contact you once more after receipt to inform you they are a)ceasing collection efforts and/or b)any specific action they intend to take ie: sue. Since the poster added a "limited" C&D to their DV request, they could take it as a full cease comm and then file suit if the debt is still w/in SOL. That's why I always recommend adding "ALL CALLS TO MY HOME OR CELL PHONE ARE RECORDED" instead of limiting contact to USPS..
