Hi All,
I finally got a live person today. Otherwise, I have been getting one-a-day automated calls from CollectCorp regarding my BofA CC. She quoted the amount that was at chargeoff. My account was charged off on Nov. 2nd. She started asking me some questions.. I was really vague with all of my answers. She wanted to know if there was anyone who I could ask about payment in full. Told her that I would ask and I know what the answer is. It is no one's business about my life. I am going to get sued anyway. One of the first things I asked was... Was there a letter sent to me? Told me that a letter had been sent to me on Nov. 6th. I just got the letter today after I spoke to her. I thought that was really funny. She says this will be sent back to BofA if they can't collect on the debt. I know the debt is merely assigned to CollectCorp and will go back to BofA. Should I go ahead and sent a debt validation letter even tho this will go back to BofA?
Thanks!

Since they are a third party collection agency and not the creditor, the FDCPA guidelines would apply to them anyway. So, just send off the DV letter. If they are assigned to the debt they must prove it to you before initiating collection.
Discussing settlement once you receive the validation would be a different ball game. Start preparing yourself to negotiate with the collectors.
