Tomorrow I will be going to the bank and closing my account. This is a huge step for me. I am so ashamed of what I have done. I hope the bank does not give me a hard time. I dont think emotionally I can handle it. This site has been the best support system I could have found. I want to thank everyone here for your wisedom and support. I dont think you all know how many people you really have helped. It incredable how many people get caught up in this nightmare. well I will update everyone when I return back from the bank tomorrow morning. Crossing my fingers....


Just about all of us here have been in your shoes at some point; As the old saying goes, the first step is the biggest. I also hope you won't have any problems at the bank; odds are very good they've heard stories similiar to yours. Please keep us posted and if there are any questions, ask!

ok, letters are all ready to go out today. Bank account is secure. Bank has been great they called me this moring to make sure I was ok. I know as of Friday I am going to have some very upset people. UGH... Had to go see the doctor to keep from losing it (my mind). I have completely learned my lesson. Complaints have been done via internet or mail to BBB, AG, Depart of Corps & FTC. Right now I have been searching the internet for a possible Attorney who would be willing to help (at the cost of the lenders). WHOA!! there is alot to remember to do here. I hope everyone here has a happy holiday. And Thank you

are these loans legal? if they are not i would not bother with an attorney, they cannot sue you or do anything to do (also i doubt they would even pay your lawyer as they are often located overseas and would never make it to court) but that is if they are not legal.
it is a lot to remember but know your rights, and know your laws. stay strong.
also the calls might not come on friday, some call right away but others do wait a bit sometimes. thanksgiving might throw them off a day or so, too. good luck, keep us posted.

None of them are legal. and I have paid 2 of them way over the prinicipal between $300 to $600 over. the other 3 I owe but just a small amount between $135 and $300. And the reason I was wanting to find a attorney is the harassment part, right now I am so stressed out I dont know how I am going to be able to handle them. The only reason I have been able to make it this far is the forum with the help and support. Everyone here is great.

honestly the harrassment might not be as bad as you think it will be. it actually surprised me because i was fearing much worse. of course it is your personal decision but i would not bother with a lawyer.. many do not know how to handle payday loans (i know lawyers in my state that have no idea they are illegal) and because they are illegal, i am not sure if there is much a lawyer can do. i know for one company i filed police reports, FBI reports, FTC complaints and none of it really did anything. i am really saying this because you mentioned the companies paying your lawyer's costs and i honestly do not see that happening.. :( they would never show up to court if you did sue them. (many are not really located in this country, which is why even my FBI reports did nothing and the others know better than to come to court)
the companies know they are not legal.. once they see that you know your laws they eventually will give in to you. it does work and it will work out. i would demand a refund for the ones you overpiad and when you make arrangements for the ones you owe, make sure they give you a physical address to send money orders to. you can pay this on your own terms, there is nothing they can do to you.

Well just got off the phone with my Payroll and they will never ever do a wage assignment, they will only do garnishment with a court order done in the state I live in. That made me fell better... She said the company has chosen to only accept court orders to prevent them getting into any legal messes.

I hope everyone has been having a great holiday. Please lets not let these criminals ruin that for us. I have a question. I have sent out letters of revoke. if they come back to me return to sender, do I keep trying to send either fax, email or mail? or do I just leave it at that? And I think Monday I am going to set up a fax online so I wont be using mine at work, even though I have already done that. UGH.. Oh one more, when you say pay them back on my terms, what if they never come to an agreement, are they out of luck?

If they return your mail, send it again as Certified. If they return that, f**k them. They can't require you to pay via ACH/wire. Any legit company would send you a letter with a physical address to which you can make a payment. Don't worry about your credit too much either. In the rare event that it actually shows up on your report, you can just send a letter to Equifax/Experian/TransUnion saying that you want copies of the original contract sent both to you as well as Equifax/Experian/TransUnion.

You guys have been great here, All I know is I am going to fight to the end on this whole thing. And my strength comes from here. Part of me feels that after monday passes and I get over the nervous of them not getting any money from me I will be even stronger. I just have to keep reminding myself it is not a crime to be broke...... Pay for necessities first, then the rest.

Oh and I have reconsidered the Attorney for know.....

UPDATE: Ok I am now in default..... Scarey.... I wanted to let everyone here know I am now getting e-mails from the Depart of Corps. with a file no. I hope I wrote enough in my complaint for them. Basicly it was how they are illegal in California and I wish to just pay the principal back. I did speak with the Attorney handling the case against, Ameriloan (oneclickcash, unitedcashloans) and she said to stay strong and the have a court hearing in May 2010 to prove they should not have immunity since they claim they are tribal. She said to tell everyone to write in their complaints, they need as many as they can get to take into court with them. She also said if they threaten anyone to make police reports. She told me that right now they can not touch anyone, all they can do is make phone calls. By the way if they start to harass me do I file another complaint?

[COLOR=black]ok, I am sick to my stomach right now. Wells Fargo let some payments post, and I called in to freeze the account. Well they asked me questions that now bother me and told me its under penalty of perjury that my statement is true. I thought I had a right not stop ACH withdraws with out getting into trouble... Please help I dont want to be introuble with the bank. I am scared these companies will try to say I never sent them anything[/COLOR]
