I called them on it. Now they say they are a first party agency and don't need a bond to collect and are threatening to sue. They said they can "outsource" the litigation process to a local attorney.
Can they do this?
How do I verify if they're really first party?
Thanks.

Call themselves UCC or United CC. Can't find any evidence of their existence. Just a rental mail box address in California. Claim I owe an old credit card debt. They don't have license to collect as 3rd party in my state, Texas. I told them this. Now they say they are first party because they bought the debt. I understand this is a lie because only he original creditor can be a first party. Correct?
They had a "law office" in california call saying they will sue. But that law office/lawyer is out of my state and not licensed to practice in my state. No attorney by the claimed name is a member of the Texas State Bar.They say they will "outsource" the litigation to Texas.
What?

Yup, they're third party. First party would be, ferinstance, BoA collecting on your BoA Visa card. They can claim anything they want, but that doesn't make it true. Are they just calling, or have they sent you something in the mail?

Is this "outsourcing" litigation just an empty threat? Since they can't practice law in my state, it sounds like a lie.

It's not an empty threat. They can hire an attorney in Texas to file suit against you on their behalf. Whatever shyster they get would still have to prove up a case, though.
Have you got a mailing address on this United CC? A demand for validation would be the first order of business. Also, when was the last time you made a payment or charge on the card they're pestering you about?

They may be first tier collectors but they are definately 3rd party and not bonded in TX. Report them to the TX SOS for attempting to extort monies from a TX resident with no active bond.

Definitely take nascar's advice, and also you need to send them a certified debt validation request letter. If you post up the phone number they are calling from, or the number they tell you to call them back at, we will see if we can help you dig up an address somewhere. This letter must be sent certified mail, and in Texas they have to validate the debt within 30 days of getting this letter, or they must stop trying to collect on it, period. Texas has the best laws for debt collection...
