It is now 11/30 and I recieved another phone call from IRG. This time I spoke with a different lady and I told her that I was waiting on a written proof thru USPS before making any kind of settlement like I was promised the first time. She looked at my account and said that I only have a 2 day window and would not have time to recieve it thru the mail, she said by the time I get it it will have a summons attached to it. I just said I am sorry but I am not giving you anything over the phone until I have proof, I also told her that her company refuses to give me their address why in the world would I give you my bank account number????
I know that I did have a loan with Advance America but I thought it was paid. It is a storefront not an online lender. It was so long ago I don't have any paperwork now to prove anything. What should I do?
Can they actually charge me with anything? Is what she is saying true? BTW, the actual payday loan took place in Florida, I now live in NC.
I am just confused on what to do, I was told to file complaints with attorney generals office but not sure which one. The one in Florida, NC or where they are in Washington DC. I looked up the SOL and for NC it is 4 yrs for a written contract but in FL its 5. Which SOL would be enforced since I am now in NC but this took place in FL. Sorry if its so confusing, they have me scared out of my wits right now!!!

You are on the right track, so don't budge till you receive proper validation from them. I doubt if you would ever receive a subpoena.
Try to record the conversation that you are having with this collector. They are surely overstepping the FDCPA since they are threatening you about a lawsuit.

Ok. So I totally understand where u r coming from, but I found out from an attorney that my brothe n law works for that more and more attorneys are now getting into the collections game and they are suing people for these accounts as well as freezing their bank accounts. I personally had this happen to me. I received a summons in the mail from Rubin & Rothman, ignored it and later was served by the city Marshalls and now I am in the process of trying to cough up $1200.00 to pay an old loan. Don't let people tell you to "stand strong" and all of this other BS. When it's too late, what are you gonna say to the judge? I was waiting on validation???? Don't think that's gonna fly.

sandy is a shill for either the illegal loan,or rubin and rothman.i say this for several reasons.
1)nobody here advises if they get a letter of collection to ignore it.
2)an illegal lender,or whoever collects for them wouldn't have a prayer in court.
3)i'm noticing shills like you bringing up scenarios just to scare people on this forum when your scenario didn't happen.for this reason.
4)rubin and rothman are not licensed to practice law or collections.that would make it very difficult to get anything but laughed out of court.

hi, I want to say that I was called by Rubin & Rothman and checked them out, they have active cases in all the NY County courts. I also called Take Charge America and they have them in their system as a debt collector. I also called Citibank and they confirmed that they are the attorneys handling my account.
Today is Sept 17, 2010 and my last payment was June 8, 2010 so being I am 3 months past due my account was sent to them! Unreal, but unfortunately true.
I will answer any summons they send, I did call and they offered a 45% settlement immediately, but had to be paid in full within 90 days.
If you visit www.nedap.ord there is a link someplace that went to ecourts in which I was able to see cases in Kings and Queens counties of NYS where the plaintiffs atorneys were indeed Rubin & Rothman of Islandia, NY.
Is is quite real, unfortunately. I am very aggravted that due to loss of work which I JUST cured they will not even allow me to resume my payments and make up for being 3 months late. What a scam. If I was able to give them the 45% of my balance up front I would though if they provided it in writing, etc.
