I am being sued by Mann Bracken for Capital One in California. There is a Order to Show Cause hearing on 12/18 for mann Bracken. Should I show up for this hearing? I have not recieved any documents from the court. I saw the hearing on the case summary on line.

Any opinions would be greatly appreciated. Thanks

GO TO THE HEARING. Call the clerk first, sometimes these things do not require an in-person appearance. If you do not appear if required, you will be defaulted for failure to appear. Have you consulted an attorney? You can find an attorney in your area by going to the website of the non-profit National Association of Consumer Advocates www.naca.net and click on the 'find an attorney' link to find a lawyer in your area. Good luck.

Hi,

Thank you for reading my post.

I did call the clerks office & they did tell me it's for the plaintiff (to show cause of proof of service). They also said that if I went to the hearing the Judge probably would not hear me at all. That they could not tell me if it would benefit me to show up. At this point I'm wondering if it would benefit me or would I be wasting my time. They also said I should/would receive a hearing date after the proof of service hearing on the plaintiff.

Thanks,
