ACE Cash Express - Help! Civil Suit?

I’m in Texas and owe Ace Cash Express $333 since the end of October. So today Ace Cash Express called my job and asked to speak to my supervisor. For some reason they didn’t call for me. The woman I guess was just confirming I worked here. My boss got her number and I called back. I started a part-time job after Thanksgiving so now I will be able to pay these loans back, especially since I’m not continually giving all my paycheck to NSFs. They also called my mother who was my referral. I called her and apparently my loan is apparently out of collections and has been transferred to her and will be reported as an NSF hot check. The number she called me from was 1-866-469-9365
Of course she was rude and wouldn’t give me any information other than I had to pay the $333 I owe immediately, since she had already made a decision and would proceed with that once she got off the phone with me. She would never exactly tell me what decision that was. She basically just told me I needed to contact a lawyer. I told her I couldn’t pay all of that. I could split the amount into three weekly payments. She said that wasn’t good enough. She then told me I was being recorded and if I was voluntarily refusing to pay the loan. I told her I couldn’t say yes to that because I wasn’t refusing. She then went on that I was refusing etc….Anyways, she told me she couldn’t work with me because it had been assigned a case number and she had to proceed with whatever it is that she wouldn’t explain to me because she isn’t a lawyer. She then told me if I could call back by Friday with a better payment option. To which I responded, “You mean the whole amount, and I thought you had already made a decision once we got off the phone?†I also asked if I should just sit at home and wait for a court letter to come because I couldn't pay that whole amount. She told me she couldn't tell me and I needed to contact a lawyer. Again, I told her I was willing to make at least a $100 payment this Friday, and since I didn’t have a checking account could I go to the actual physical store and make a payment. She said no because I got the loan online. Is this true? Although I took out the loan online, I actually went to the store to get the money, so they must be connected somehow.
So my main questions are:
1) Has anyone ever made a payment at the store for a loan taken online?
2) Has anyone ever just mailed a payment? Know the address?
2) Has anyone ever been taken to court by ACE over this?

Thanks! From the other thread where someone was having the same problem in Dallas, I decided to go to the store and make a partial payment there. At first she told me I couldn't make a payment because I hadn't gotten the loan there, but when I told her it was in collections she accepted it and just told me to save the receipt. I'll be awaiting a harassing phone call tomorrow, but now I can at least tell them they are liars because I could make a payment. I'll continue to make a payment until the store won't accept it. If they still somehow take some legal action against me within the next 3 weeks, at least I can prove that I was trying to make payments and I wasn't trying to steal or commit fraud or whatever else.

Well my case manager called again this morning rather upset that I made a payment. She asked me why I did that. I lied and told her I consulted my lawyer friend like she told me, and that I was told that until I received written information that I was being taken to a civil suit or owed on an NSF, that I should make an attempt to pay that debt whichever way I could to show that I was not refusing to pay, and since I was still able to pay on that debt that meant it was still in collections and not in a civil case status. I also told her that she gave me wrong information when she told me I couldn't pay at a store because I took the loan out online. Of course she told me she never would have said that. She asked what my intentions were in regards to this debt. Told her that I planned to make payments until it was paid off and this was going to be my answer everyday she called. She said this was not going to make the problem go away because it was an NSF issue and that she was not going to be calling me ever again. I said that's great, but can you tell me when I can expect to be served with papers, go to court whatever so I can go ahead and pay this, to which she said "contact your lawyer friend and they can tell you."

It sounds like she realizes she made a big BOO BOO. lol I think if I were you I would write a letter to the corporate office about this, I would name names and give details. I would also inform the corporate office that you are going to file a complaint with your attorney general's office about their poor business practices, and please follow through.
