Below is what Unitedcashloans responded back to the BBB, I responded back telling them they had the false assumtions since they know they are illegal in California, due to the fact that they are currently going through a court hearing. Dont know how I should follow up now. Please help...

This was in your agreement, emailEd to you 2 times before funds were in your account, DID YOU BOTHER TO READ? We suspect not, if you did read it, WHY DID YOU NOT RETURN OUR FUNDS WITHIN 48 HOURS AND NO FEE WOULD HAVE BEEN ASSESSED? THERE ARE MANY CHOICES AVAILABLE WHEN REQUESTING A LOAN OF THIS TYPE, WHY DID YOU ENTER INTO AN AGREEMENT WITH US IF YOU HELD SUCH FALSE ASSUMPTIONS AS YOU PLACED IN YOUR COMPLAINT:


Governing Law: Both parties agree that this Note and your account shall be governed by all applicable federal laws and all laws of the jurisdiction in which the Lender is located, regardless of which state you may reside, and by signing below or by your electronic signature, you hereby contractually consent to the exclusive exercise of regulatory and adjudicatory authority by the jurisdiction in which the Lenders is located over all matters related to this Note and your account, forsaking any other jurisdiction which either party may claim by virtue of residency.


Well, wherever the lender is located, follow up with this response:

Please note I am not a resident of (insert location), have never prescribed to be a resident of (insert location), and have no (insert location), , as such am not subject to the (insert location), laws you detail. I am however subject to the laws of the state in which I reside. The end.

I did responed back and stated that it was a very unprofessional response, and that this company can not use the excuse that they do not have to follow california laws cause they are currently going through a court case right now about them illegally lending to California residents and they are the ones who are false in their diseptive practic by praying on unsupected consumers who have no clue they are illegal. I hope that works but I dont think it will. I also stated no matter what I live in California and I will follow California Law and be protected by California Law.

Thats all I have is my law. The sad thing about this whole thing is I am in college studing to be a paralegal. I should know better. I think thats what makes me the maddest. I think I am going to take some time to see if I can find some case law on pass cases in California. See if I can scare them with that. Crossing my fingers.

I wouldn't really expect any action from the BBB. IMO the purpose of filing a complaint with them hopefully helps some other unsuspecting person in the future if they should decide to consult the BBB prior to obtaining a loan with UCL. If they read your complaint it may encourage them to think twice before applying for a loan. The more negative information compiled against these illegal lenders on the Internet increases the chances of less people applying for loans. At least those are my hopes.

yea, the BBB is great for warning people and for reputable buisnesses who care about their reputation they are good because the buisness will not want a bad name. but for illegal lenders, they do not care if people report them.. still it is good to warn others and for a place for others to get their contact information from.
