Mann Bracken sent a letter for intent to sue for AMEX card, interesting that I am making payments and Amex is accepting them. Can they sue when im making payments to the original creditor?


If Mann Bracken has indeed been retained and authorized by Amex to file suit, then they may proceed with suit. Creditors usually will not refuse payments - they'll take it and credit your account. But the fact that you are making payments does not mean they cannot consider you to be in default. If you haven't been paying as per the terms of the contract, they can still file suit.

I haven't been following them..... so I wasn't aware of that. If they file a Chap 11, however, they can still continue their business operations ..... Unless they've had cease and desist orders issued against them to stop collecting (like I said, their name is familiar, but I haven't been following the issue.)
