forcing EX to consolidate debt to fullfill divorce settlement.
Date: Thu, 12/17/2009 - 16:35
i don't get it...the debt is all in MY name because i was the one taking our daughter to the medical specialists...he assumed responsibility before the court and it was on the divorce decree that he had to get all debt (including a VISA) into HIS name but he can't get a loan to pay it all off and has not done so on any of the bills. He said he's trying to pay them and they won't take it off my credit report until he's paid down 90 days on them but that still means I AM LIBLE for them.
Can he get a consolidated loan management company to combine them if they are in MY name, our married name or am i stuck with these for life, should he reneg on paying? DO i have to take him to court to get these paid and can i garnish his wages? He's doing fine money wise as he's having vacations with our daughter, not paying the mortgage on the forclosed house we lost, etc...so his credit is not good but he is the one with the job.
i have care for our daughter who has 5 diseases and so the brunt of her care is still on me and my new husband and my Ex only has to pay a small amount of child support as he lied about his income before i got remarried. i need help!
help!

You cannot force any creditor to change the name on the account.
You cannot force any creditor to change the name on the account....basically a divorce decree means nothing to them. You would have to haul his ass back to court to force him to pay...

Divorce decree does not supersede a contractual agreement in contract law. You can try to get a civil judgment and ask for a wage garnishment, maybe, depending on your state law.
