HELP! I received a Civil Action from these evil people Dec. 4th for a Capital One debt. I was unemployed for 14 months and now am working but at much less than I was making before. I would be willing to make payments but with the 8% interest they want I would never pay them off. I have never been sued before so am scared to death, not to mention I am behind on everything, my spouse is now out of work as well and we cannot afford an attorney. Will these peole be able to take any property or worse freeze my bank accounts? I have read about T. French and know I do not have anything great to look forward to. I live in NC, I am trying to write my court response to file with the clerk of court now. The amount is $4450 which I know means they have been charging interest this whole time.

Any help is much appreciated!

you can respond that you wish to request validation during discovery.has this place ever contacted you before?if not then that is how you answer.btw the most they can do is put a lein on your house.they can seize bank accounts if they get a judgement,but if you answer that isn't a given.they can't garnish any wages or income so you are safe there.chances are they can't validate and it could get dismissed.answer that you want them to validate during discovery.

To be honest they did send me a few letters but I have been in "ostrich mode" and just can't stand calling people and telling them I don't have any money, since they are so nasty. Even so should I ask for a validation anyway and do you think since it is mine they can definitely prove it? If they seize my bank accounts I am really in trouble! Thanks a lot for the response!

there is no guarantee they can prove they have legal right to collect.answer the summons.get a court date,and request validation during discovery.if they seize a bank account then whatever money goes in they get.if you don't get direct deposit,or cancel direct deposit and cash your checks elsewhere.just if there is any money in there or any future money they can take it.answering the summons is key even if you just answer that you want a court date.at the worst the judge will take your case into account and set a payment that will work for you.again answering the summons is important.

I just received a summons on Nov 20 of this year, I asked for an extension, I have an appointment to consult a lawyer next month so i'll probably ask for another motion for an extension, the beauty of this is the SOL is going to expire march 14th 2010, I can not wait to slam dunk this case in there face
