Today I received a letter from M.R.S. Associates in Cherry Hill, N.J. This agency is apparently now in charge of collecting a debt owed on a credit card. The balance is $5400, but the letter is offering an opportunity to settle the debt for $1623.36 if we make the payment on or before January 13th. This sounds like too good of an offer, but if this is a legitimate offer I might want to take advantage of it. Any advice?

Has the agency shown you any papers proving that they are in charge of collecting the money from you? How do you know that? There is a way of knowing this fact. The company must send you the details of the debt before collecting money from you. If they have sent it in writing, go ahead and make the deal further.

collection agencies make settlement offers only when they own the accounts by themselves. They can also make such offers if they have been authorized by the creditors to do so.

Your next move is to get it in writing from them that they or the creditor will be updating your file with the bureaus. If they can put this statement in writing and send you the receipts, you have a legal proof to defend yourself later. I will get everything in writing from the company before giving my money to them.

John that isn't necessarily true. I work for a collection agency and I am authorized to negotiate with a standard blanket settlement and my company is authorized to settle to a certain point and my VP of operations can approve settlements even lower on a case by case basis all without buying any debt. I know this is an old post but I just came across this thing so I thought I'd say that. Actually I work for MRS Associates and that is a 30% settlement which sounds right for certain work streams.
