I live in AZ and I have four payday loans out right now and they are as follows:

Cash1 $300
Checksmart $200
Advance America $500
Check into Cash $375

All of which have now defaulted. The bank account was closed so they cannot take my money, however I am receiving calls from them even though I have explained my situation and advised that because of family illness and other financial issues, I cannot afford to pay them all off or continue to refinance and pay their hefty finance charges. Cash1 has contacted my employer, and I would like to know if it is legal for them to do so once I have advised them over the phone that I absolutely forbid them to contact my employer? Check into cash even called my landlord! What are my rights as far as stopping them from contacting anyone other than me?

cash one is a pain. they are very persistent. they finally quit calling me at work but i had to make up stories about how every inbound call was recorded and reviewd and how they were going to get me fired. i also dealt with checksmart. their corporate office people wernt very nice. i know they are not bound by the fdcpa but i sent c&d letters to the store and to the corporate office and pretty much the only one that didnt care was cash one, i got both letters returned undeliverable. also cash one has been telling me for a few months now that they are sueing me and i will be served in 48 hours. still waiting. do you have a game plan or know what you are going to do?

I know that Cash One is online and here in California, also has storefronts in some areas. This is important, because if you got your loan from one of their storefronts, chances are they are licensed in your state and they could easily sue.
With that being said, although they say they are suing in 48 hours, the wheels of justice don't work that fast. They might be filing the paperwork, but you're probably not going to court much before February. This will give you time to pay off a big chunk of what you owe. If you do get summoned, I can not begin to tell you how important it is TO GO to court on the date, because if you don't, you lose by default and that is what these companies are counting on. Good luck, and speaking as one who has been in your shoes, we do care. Keep us posted.
