Problems with Federal Credit Corp...

Okay, I am in Massachusetts. This company is not licensed in MA to collect debt so they shouldn't even be contacting me. They did contact me, I responded with a DV letter within the 30 days. After they got the DV letter, they continued to call about 4-5 times and they said they didn't get it. It wasn't until I told them who signed for it on the green card and the date they got the DV. They have not called since.

They where also on my credit report and I got the results back today. The account remains and it was not updated to show that the debt is disputed. I figured I would do the 1-2 punch DV first then it popped up on my credit report then I disputed. I know it's on Experian, not sure about trans union had a little problem viewing my report,need to call them but it isn't on equifax. I am about to report them to the state for unlicensed collection......What else can I do? Is this report accurate? I might add that the last time a payment was made was probably 2003 it was not opened in 2009.

Well I sent in my complaint to the MA Division of Banks today. I sent the complaint letter, the dunning letter from Federal Credit Corp., my debt validation letter and a copy of the green card signed for. Now I just have to wait on that end to see what happens.

I thought I seen one law in MA that said a debt collector cannot report to a consumer reporting agency in the debt collectors name but with the written permission of the original creditor, they can report in the original creditors name.....Having a hard time finding it under the actual laws, ony in the debt collection laws is it listed.

I got a quick response today by mail from the DOB in Massachusetts. Apparently they told this debt collector to cease collection activity July 11th, 2008 and they did not respond to the affidavit the state sent them. They are now warned again,lol.

The letter they sent to federal credit corp is actually pretty good. It also says they will be put in the media, and also the AG. It goes on saying the state can sue them if they want, which is a $500 or 3 months in jail or both.

"Federal Credit Corp's Willful disregard of Massachusetts statutes and regulations and division directives is alarming"

HA HA I love it!!!!!!

So I guess my question is, they verified the account on my credit report but did not validate the debt. It does not show disputed on my credit report. IF they do not delete this account and verify it again, is that good reason to constitute continued collection activity thus violating Both the FDCPA and MGL and also violate this cease and desist letter the state just sent to them to stop collections in massachusetts? Is it kind of a gray area?

yes reporting,or continued reporting on your CR is considered collection activity.report this to the proper authortities.so it is not a grey area.show your validation request to the MA DOB,and let them handle it.also with the credit bureaus as well.

I sent everything last month to the state showing them, including a copy of my debt validation letter they never responded to. So now as is stands they have 2 weeks to respond to the state and tell them that they will cease all collections in Mass.

I did everything roght so far, I was just wondering if I should sue them if it comes back verified again, thus continuing collections in Mass by reporting on my credit report. It is only on my Exerian credit report, they didn't put it on any others.

thats odd .. i have found the exact oppposite from this company i have been dealing with a person in there legal dept that has been nothing but awesome to me and helping me stop harrassing call s from a company who wanted to settle this debt i have with chase.. for double what i owe.. federal credit corp wants just what i owe.. hmm glad im looking into all of this .. ill think ill call chase and see who actually owns this acct..

They have no legal department, for them to even state that is illegal. Are you in MA NCOTE???? If you are, DO NOT PAY THEM A DIME!!!!!!!!!!!! They cannot even sue you just so you know. They are not licensed in any state, they are only bonded in Texas. They are also not incorporated in any state but Texas.

they where removed from Trans Union in less than a week. Experian I disputed, waited 30 days and it was verified. I disputed again and I am still waiting, getting close to 30 days. Funny how TU was quick and Experian is SLOWWWW..

Looks like I might be including them in a lawsuit too.

Send another letter to Experian, demanding to know the details and method of verification of that account. Enclose a copy of your validation letter, and of the green card showing the CA signed for it. In your letter to experian, state that you have received no validation from the CA, and demand that this unvalidated account be removed from your credit report. If they waffle, follow it up with an 'intent to sue" letter (to Experian), citing FCRA and possible state law violations. You don't need an attorney at this point.

Experian verified the account again and did not remove it.

I will say that Federal Credit Corp must be really stupid. After being told to cease and desist for a second time by the state, they have contacted me by mail again, but this time they used a law office on their letterhead. The envelope plus the address and phone numbers are all Federal Credit Corp plus the people to contact work for FCC. It is almost like FCC decided to put a different name on their letter to scare me into paying. The attorney is only licensed in Texas.

Law offices of W. Thomas Engle PLLC. Looks like they might be getting sued too cause they are not licensed to collect debt in my state either nor are they an attorney. The violations just keep adding up!!!!!!!!!!



Is that illegal or what?
