Hey, quick question - i have been getting calls at work from Marval and Associates. I know it is payday loan related but who are they?? i have not taken a loan out since March 2008!! And they really are settled up (I over-paid on almost all by a lot, a lot of money.. the rest were taken care of).
I got a call today, I was in the middle of speaking with a supervisor and I recognized her voice (her name is Kathryn). She asked for me and I screened my calls, said I was on vacation. I did not want to get into in front of my boss. (i sent them a c & d in the past, also a letter asking how are they.. because really i have no idea who they claim i owe).
She gave me a number for myself to call back and than asked me to repeat it, i laughed and said i am not your secretary and hung up. she than called back and i switched her to voicemail.
Does anyone know who they are??? I might have mentioned them before but have no idea why they claim i owe (nobody!). All i know is they keep doing the check fraud thing, i just ignore them because i know i did not do anything wrong but it is bugging me

Next time they call I would tell them they have 5 days after their first initial contact with you to send you a dunning letter in the mail (which they probably won't). If they call again after you have requested a letter via mail them you can file a complaint with the FTC against them. As you know they are required by law to send you a letter of collection via the mail after they contact you. Start keeping logs on when and where they called so you will be able to write out a detailed complaint. One of the things I have learned about filing complaints with the FTC is the more information you give them, the better the chances of it receiving attention. They don't want to do any of the work and are more apt to 'file' letters without a lot of info. And always begin your letter with a brief statement of the complaint with the collection agency's phone number, address, name, etc. If the FTC sees all the pertinent information in the beginning of the letter along with the 'main idea' (brief statement of the complaint), then they are more likely to place the complaint in their "to do pile" rather than just file it away for a rainy day.

I understand how you feel. The problem with these illegal lenders is they seem to never go away, but education yourself on your rights and how to handle the situation is the best weapon you can use against them. :)
