I asked for a debt validation letter and she said she didn't need to send one, which I called foul on and said I have got to have something, so she agreed to fax me over something, which I haven't seen yet.
Do you think I can get them down any further if I call right back with cash ready to go? Also, has anyone ever been sued by them. Are they the real deal or just bluffing.

On a side note, I don't have any money at all right now or I would give them something, but I literally have $2 in my bank account. I want to repay them eventually, but I have nothing. The only way I can make a settlement is by maybe borrowing some money, but I have pretty much used that card up on all my other business debts I have been trying to settle.

After you receive your letter of collection you will then have 30 days of which to dispute the debt by requesting validation, which should be done via the mail certified return receipt requested. If I were you, I would tel them until you receive your dunning letter you aren't going to discuss it any further with them. If they continue to call you after you request a letter of collection I would file a complaint against them with the FTC. Sounds like you're going to need to stay on them. Never agree to anything over the phone, request it in writing.

Tell them you NEVER received a dunning letter and send it asap or stop calling you. You need to ask them what address they sent this alleged collection letter to, also ask the name of the person you are speaking with and their employee ID number. Let her know you are keeping a log of the date, time, number received a call from, name of employee, etc. just in case you will need it for FDCPA violations. The more you educate yourself on the FDCPA, the more time you will buy and it will probably lessen your chances of ever being sued. But the thing is, even if you are considering a settlement with them you still NEED proper documentation, so continue to insist on a dunning letter, call them everyday if you have too and keep a log of it.

we have deelings with them over capitol one accounts. we joined a consumer debt law firm and johnson riddle and mark are still setting liens on our homes and wants to garnish my husbands wage. the debt was 5800.00 and we got a settlement for 4000.00. has to be paid by the end of the month or they will go ahead with garishment.we have 3500.00 of the 4000.00 today but they wont take that. they told me the only way to stop these people is file for bankrupsty. they wont even let us make payments. we thought when we joined the consumer debt law firm it would stop action but johnson riddle and mark are still going forward.we call and they are so rude on the phone. they have even hung up on the consumer debt people.i feel like they should be shut down.......

So okay on the 25th of Feb my Law firm contacted Johnson riddle and mark on my captiol one account that we had the $3500.00 of the $4000.00 they wanted to settled ask if they would take that they said NO.. so here we are one week later the $4000.00 has been sent to the law firm to pay them, will when they go to send it they said NO because it was a few days late so now Johnson riddle and mark want $500.00 more..my hell people.. the person at this company is rude, not nice, and even hangs up on us.What can we do about this... they need to be stopped. I have filed a complaint with the BBB of Utah, The attorney generals office, utah state bar , and the FTC. Even the Consumer Debt Law firm cant talk to them.

Any body have any thoughts on how to handle it now? I know they try to scare you more than anything. I will go to court by myself if I have to so they can't just get a default judgement against me.

I already suggested in this thread what to do but you gotta take the offensive and read, read, and then read some more....By the way, I just kicked Cap1's butt, result case dismissed....Point is, elect arbitration and Cap1's gonna get stuck with a bill for 5K + to proceed with the arbitration, they have to pay this win or lose...Nobodys gonna spend 5K+ pay an attorney a fee to maybe get 4500.

I just got done dealing with them they are no joke. They will sue you and they will win. Then they will go after your paycheck!!!! Mine went from 350 to 1500. I paid them 1100 and now they are gone!!!

I've been dealing with them myself. To be honest I don't know just how legal their added charges are but if it helps any of you to know, I am working with a man named Guilbert and they ARE accepting monthly payments. It required alot of kissing A** but it's been a managable situation. It seems threats and other such statements wouldn't go quite as far as admitting fault and being willing to settle the matter. At least it has worked for me anyway, but I AM responsible for the debt... I hope that's been helpful to anyone. Good luck!

so you admit fault after they threaten you,or before?again it doesn't matter if you owe the debt or not.this bottomfeeder must prove they are the ones who are legall entitled to collect.i wish you luck as if this is true,then they will not keep their end of the bargain.they will keep debiting,or sell the debt once you are done with them.sorry,but i never just pay anyone by phone over the phone.i want it i writing first.don't recommend your course at all.

These people have been a nightmare! We have a consolidated credit cards payoff aggreement. This company convinced my husband to set up a electronic bank payment. After several months of paying $200/mo, one of the credit card companies filed a judgement against us stating they were not getting paid. When calling Johnson, Riddle Law Group, they just said that that particular credit card company would not work with them. This was after we had already been paying the law group for about 6 months 2009. Where was this money being dispursed? My huspand called them and they were going to work it out, but we ended up paying a larger amount out-of-pocket to pay off that particular account. We did ask for confirmation of all debt and payments made showing who was getting paid. Never did get anything in writing. What can we do and are we getting screwed like a lot of people. Can we stop these electronic payments until this is settled? Should we contact the FTC and the Idaho Attorney General's office?
