Got response from BBB on PDL

"Emergent Funding is not a payday loan company. We are licensed in the State of Missouri as an installment loan company. Msxxxxx signed electronic disclosures, stating that she agreed this transaction occurred in the State of Missouri and would abide by the laws of installment loan lenders in the State of Missouri (Adobe copy attached). Ms xxxxx gave no indication prior to her email that there was an issue; this could have been resolved merely by her reading her disclosure prior to signing and after receipt of same, sent via email along with her contract and payment schedule. Ms xxxxx also had a 3 day right of rescission and could have returned the entire prinicipal amount loaned to her: this would not have caused any repercussions. This is clearly stated on our website."
I asked the BBB to reopen the case and sited the Ohio law and that it doesn't only pertain to payday loans, it states indicates short term loans.

They reopened the case, but then closed it again when the lender
They reopened the case, but then closed it again when the lender responded by saying that they are standing firm in their position that I am bound by the laws in their state. Are they right???? They are the ones who sent it straight to an attorney and the attorney letter indicated I owed $875 now. I originally only had about $250 more to pay them. Should I contact them now and ask if I can just pay the loan off. I'm so afraid that I did the wrong thing. I sent my debt validation letter to the attorney. What do I do now?

They are totally wrong, unfortunately the BBB isn't very helpful. Just stand your ground, one thing for sure, they wouldn't dare sue you, I have yet to hear of anyone being sued for real by an illegal lender, threats galore but never sued.

Shazzers is correct, I spoke with one of the Attorneys at the Department of Corporations in California and she told me the same thing. She also said they would not dare try to take you to court in your own state cause your laws will preveil.

the same complaints.this attorney must be licensed and/or bonded to collect.they also must follow the FDCPA as anybody attempting to collect a debt.they are subject to the same treatment that other collectors are.
