LVNV Funding trying to collect on a PAID debt.

I had an old debt with Citibank for a MasterCard, and being a young dumb college student I let it go until it went into collections. In 2007 I was contacted by a debt collector, and made arrangements to pay a lower amount. That collection agency tried collecting the debt before the agreed upon date, and consequently the payment was declined. However, we did get back in touch with each other on the same day the payment was declined, and i paid with an alternate method. I repeat, I PAID the debt.
Last year, Resurgent Capital (LVNV Financial LLC) called me trying to collect on this same debt. After being threatened by the agent, I contacted my Union's attorney and the debt collector that I had paid. I got a letter of payment, and forwarded it all on t my attorney, and the matter was settled, I even got a letter from Resurgent stating that they had received confirmation.
Yesterday, I received a letter from Redline Recovery (LVNV Financial LLC) trying to collect on this same debt? I called in and spoke with someone and told him that this had already been paid, but apparently they are requiring me to prove it AGAIN. What can I do? Can I sue these deadbeats (LVNV)? Can I file fraud charges against them? Of course I am moving and all of my paperwork is buried in storage (If I didn't accidentally throw it out while cleaning, I threw out a lot of stuff). What are my options here?

unfortunately this sort of thing happens a lot. why it happens? i dont know, maybe someone else can enlighten you on this. frankly you might just have to keep copies of the paid in full letter stating the original account number and creditor and the fact that it was paid in full (or settled for that matter) and forward copies to those who try to collect on it. in the meantime keep an eye on your credit report and make sure they dont report it. you MIGHT want to try contacting LVNV, though they might refer you back to the agency collecting. but if you slow them down and explain the situation they might be able to help... or not. but its worth a shot.

I think I'm going to go ahead and send them a verification letter to dispute it. In the meantime I will get another letter of payment from the company that I paid, and re-collect the rest of the information necessary to prove that I did pay the debt. I did request copies of my credit report, I'm only waiting on Experian. I think I'll contact my Unions lawyer again and see what he recommends. Thanks for the suggestions.
I did try calling LVNV, but the number went to Resurgent, and they didn't want to talk to me about it. They did just refer me back to Redline.

When I made the payment to the original agency, they took the money out 2 days prior to the agreed upon date, and the payment bounced. I called them the day that it bounced, and paid them with my mother's credit card. That was what the rep from Resurgence said was the problem. They saw the payment, then the bounced check, and their system did not show the second payment, until they looked into the matter further. They actually sent me a letter saying that the debt was verified as paid prior to when my attorney was going to contact them. Like I said, I was a dumb-a_ _, and apparently did not keep all that paperwork.
Of course now Resurgence won't give me any information regarding their attempt to collect on this debt. I have to wait until I get my Experian credit report to get the original collectors (that I paid) info to call them.
And I am certain that if I did settle, that I didn't request them not to sell the rest of the debt. And I'm sure they don't give that type of thing away without being asked.

i would find proof of payment then send a DV letter to resurgent.they are connected to LVNV as one of there affiliates.these two also play collection ping pong with a couple of other bottomfeeders.not suprised by this as LVNV is the ultimate bottomfeder,and RESURGENT is one of the tentacles on their collection octopus.get the DV letter out certified mail return receipt.above all else don't pay a dime without documentation.

Ok, here's an update. I looked on all of my credit reports and that debt is no longer shown on any of them. It does not even show up as a collection account, past or present. How do I track down the collection agent that i paid to get proof of payment? This was 3 years ago that I paid it. And my mom does not have access to 3 year old credit card statements. Should that payment show up on the DV if they can provide it?

Have your mom check with her credit card issuer--they are required to keep records for a certain number of years before they send them to archives. You might get lucky there.
Also, keep digging for that paperwork!
