I would definitely recommend going to ftc.gov there you will find very helpful information as to what your rights are when dealing with collections agencies. As to the "pre-legal" department, you stated that the account was charged off in December, therefore the account is now no longer with Bank of America and has been placed with a collections agency that is trying to use a scare tactic in order to get you to pay something. Depending on the state that you are currently residing in and the laws that apply to your state, the Collections agency may or may not be able to sue you and that???s if they have legal representation in your state. Sounds like my experience with my BoA CC- before charge off, it was referred to Redline Recovery for them to collect. I was the first (and only person) to make contact. I got the letter saying my account was being handled by Redline and called in myself, they never once called me...
The man I spoke to was very rude, he wanted to give me a 10 minute speech about how he knew what I was going through because when he was younger, he too was "screwed over by CC companies" and yada yada yada...I wasn't going to listen to his sob story so I just cut to the chase. I said, I've looked at BK, spoken to a lawyer and once I said that, he got nastier. He flat out told me I would never qualify for BK because I own a house (I do own a house, but that doesn't make me ineligible for BK, I've spoken to a BK lawyer, I qualified because of my amount of unsecured debt). Then he goes on to say "I don't know what lawyer you spoke to, but he obviously doesn't know what he's talking about". Excuse me? Are you, as a collections agent telling me you know more about the BK laws than a BK lawyer in my state??? So I said that, he did not like that one bit...then went off and told me how I'd be surprised how much money he makes (please) and how he makes the economy in the US thrive (really?). Admittedly, what I did was wrong (backlashing on him about him not being a BK lawyer). I shouldn't have stooped to his level and just kept a cool and level head, but he was just pissing me off...he ended up giving me a settlement offer after our agrument and said it was due in 3 days and HUNG UP on me. Nice...right?
Well here's the silver lining- not even 2 weeks after my conversation with the jerk from Redline, another calls me, and offers me 32% in one lumpsum...took the deal, couldn't pass it up, and she was the nicest agent I've dealt with yet...So after the big long story (sorry) I guess my advice is to call the phone # you have for the agency collecting (if it's BoA, or whoever) and just keep trying until you find an agent that is actually halfway nice...there are always the scumbags that don't seem to have any sympathy for anyone, but once in awhile you stumble across some that do genuinely want to work with you. Just call again and call again until you get someone a little more understanding...hang in there. My settlement of 32% with BoA happened just after I passed 150 past due.

He did say that he was still from B of A but the " pre legal department". Dec was charge off for me. My problem being, not having enough money for what they want. I have around 5k to settle, but they are asking for 7600 right now. He threatened me with a lawsuit, and then proceded to tell me that I shouldnt have gone out and spent all my credit on "luxuary items". His office was based out of Toronto Canada. He is even calling my husbands and my cell phones. When he got ahold of husband, he got an earful about threatening his wife and then my husband asked to speak to his boss, as he was not dealing with the guy. He told him he wanted someone professional, and would not deal with him again. The second guy was nicer and seemed to be pushy but not rude or nasty. We told them we werent trying to get out of paying it, but right now, we just couldnt. We have our mortgage through B of A as well and are on time. They also made the comment that with our decent credit, and being able to make our house payments that it showed we could pay it, and we were just trying to dodge our credit cards. We are just hanging on, and every month its harder and harder and now the last 2 months ive had pay late payments on the house and car. Thanks for letting me vent and the info.

Bank of Am is weird. I am weeks from chargeoff and still in house and no rude people talking to me. They actually offered 30%. Manleyx4. You said you have 5K but they want $7600 now. I alson with many others on this board settled other cards with them and they did 3 installments. Tell them that is what you want. You need to talk to someone elsd though if possible.
I asked for installments on the 30% and he said "We normally want lump sum but may be able to work it out" I think your rep is just bullying you.
You asked if you have some time to figure out, it all depends on how late you are. They will keep for atleast 6 months.
