HELP - Question

I've sent this company many copies of my C&D letter, they sent me this email today.

"We have been unable to contact you regarding the past due status of your loan. We will be reaching out to the references listed on your application as well as to neigbors living near your mailing address in order to locate you. We just need to communicate with you in order to schedule a payment."

They can't do this can they? Isn't this againt the collection practices to contact my neighbors, I realize this is a scare tactic, but I want to repond with the correct siting of the law.

then you re-send your C&D letter to include everybody.then if they do you can take proper action.again they are not to call anybody period.send that to them asap.an illegal lender will do that.cover your bases.also if you haven't filed AG,AND FTC complaints against the bottomfeeder.do it asap as well.one last question.who is this threatening you?

Flo Bridge they are located in Utah, I resent the letter for the 10th time. Also, I have filed all my complaints against them. The license on their own website clearly states they cannot loan to other states. I filed a complaint with their state as well. Thank you for the quick response. They haven't even tried to call me, just keep ignoring my emails.

First why is it so difficult to get a PDL mailing address, second why would they send me an email like the one below. Can they refuse my payment, what happens if they do?

Sue, don't allow them to bully you. Just respond to them, no address means no payments, the end.

Then leave the rest to them. If they don't acknowledge your email, or refuse to give you a legit address, then tell them they made thier choice.

I have a payday load with Ace cash express for 1000 dollars I have defaulted on. I have tried to make arrangements, however, they want more than I could pay. Now they have called my referances and they have called telling me of a case pending against me. So I returned the call only to be told on Monday that they will be contacting my employer for wage garnishment. I live in Texas, are they allowed to do this?

They can't garnish your wages without a court order, however, they can use a wage assignment which is quite different than a garnishment with the same results. You probably signed a waiver when you obtained the loan which stated if you default on the loan they can attach (wage assigment) your wages. The good news is, it can be revoked at any time. All you need to do is send them a letter stating you revoke their rights to an and all wage assignments. Then, take the copy of the letter to your employer, they can no loner attach your wages. Keep in mind they can still sue you though, in that case they could get a judgment against you and ask the judge to impose a wage garnishment, but, there are other avenues you can take to prevent that from happening too. For now, just send an email or letter via the mail (certifed, return recept requested, very important!) asap! A sample letter is below.

Dear Sir or Madam,

I hereby revoke your right to use any wage assignment I may or may not have signed with you. You no longer have my permission to use this wage assignment, which is a federal law. If you fail to abide by my wishes, there will be consequences to your actions as I am sure you are aware. I have sent a copy of this to my employer, therefore any wage assignment made by your company will be denied.
