Validation letter sent, no reply, then 2nd collection agency comes in?

I sent a validation letter last May of 2009 for a debt to Macy's that was in collections. The first collection agency, did not respond to the letter that I sent CMRRR.

Macy's the original creditor mailed a letter 35 days after the collection agency received my debt validation letter stating that I owed the debt and that the first of several collection agencies would be contacting me but the letter did not show any proof I owed the debt.

I checked my credit report and the first collection agency had not reported the collection it to my credit report. I never heard from the first collection agency again.

Now 6 months later in December 2009, a second collection agency, Blatt Hasenmiller, claims to represent the creditor for collection.

I want to pay off the debt with the original credit so I can request that the record be removed from my credit report but I need a couple months to come up with the total amount. It is about $7000. in total debt.

My question is what should I do about the new collection agency? Should I send another debt validation letter to this new collection agency?


Yes, you need to repeat the process.

It happens quite often when the first collection agency can't validate the account and they sell it over to another one. You need to make sure that you're paying to the right party and hence validation is required. Send the debt validation letter to the new collector.

You could file suit against the first collection agency if you have documentation proving you DV'd them. They are supposed to mark the debt as disputed and the next collection agency who picks it up must validate before collecting. Either that or the 2nd collection agency ignored the dispute and attempted to collect anyway.

That is why you would include both in a lawsuit, let one or the other prove their case.
