I received this message back from Eastside Lenders. I live in Ohio....Not sure how to respond....

East Side Lenders, which is located in Delaware, is licensed by the State of Delaware to make small loans. All such loans are approved and funded in Delaware, with repayment to be made in Delaware. The East Side Lenders loan agreement and website contain all disclosures required by Delaware and federal law and make it clear that all transactions are governed by Delaware law. On the advice of counsel, East Side Lenders maintains that the choice of Delaware law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Delaware. The loan agreement is legal and enforceable. In responding to your correspondence, East Side Lenders notes and reserves all available legal and equitable objections to the points you have raised.
East Side Lenders provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. East Side Lenders will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.

This is their standard form letter. They will not give up, however. I hope you've closed your account because they will continue to debit funds until you do. This company gave me the hardest time out of all of them. They even went as far as to return my $5 money order (five times so far)...but I keep sending it back.

I sent a message back and told them that I live in Ohio and not in Delaware. They responded back saying that it was like I walked into a store in Delaware even though it was online....is that true? Or does my state laes prevail? I did file a complaint with Ohio Attorney General.

they are full of it.let them know that in your response as your state law prevails over their delusions.

I used the billing or collection issues classification. Here is a copy of my complaint.

After doing research regarding Internet payday loan laws in the State of Ohio, I have found that the above mentioned company is not permitted to make loans to Ohio residents. On (date) I contacted the company via email and offered to pay the remaining principal balance of my loan. I also revoked ACH debit permission and wage assigment permission at that time. My offer was refused and I was told that I still owed the entire principal amount and that the money I've paid thus far ($amount) was only "interest." I was also told Ohio law does not apply. On (date) a $(amount) debit was presented to my checking account which my bank returned unpaid.

On (date) I contacted the company again and let them know that I am aware they are an illegal lender for the state of Ohio. Due to that fact, I am only required to repay the principal amount of ($ amount borrowed). According to my records, I've made the following payments: (list). The total of my payments equals $____. I am willing to make the outstanding payment of $_____ via money order only and have informed the company of that fact.

After the $_____ balance is received, I would like my account to be marked paid in full. I want no further debits presented to my account. I want no contact to be made with me other than via email or US postal mail. I also prohibit this company from contacting anyone other than me regarding this loan. I have also filed complaints with the Ohio Attorney General's Office (complaint #___________).
