collection agency problems

this collection agency calls me and says i owe them but they have not verified my debt in writing even though they say that they have sent notices, they are very threating on the phone. Today the woman said if i didnt make arrangements with her immediately that it will be sent to litigation. i dont even have an account number to respond with a letter. What do u suggest?

You need to take a stronger side while dealing with the collectors. Be aware of the federal laws that restrict the collection agencies to use scary tactics and abusive language while they are attempting collections.

Be suspicious and ask for every possible proof while dealing with this collector. Ask her to verify the address where the letter has been sent. Also, ask her to give you the SSN# and other details that prove that the company is actually holding your account from your original creditor.

If it is permissible in your state to record the debt collection phone call, do it to gather some legal proof. If your state does not allow recording of the phone call, inform the other caller about the call being recorded for legal purposes.

In any case, if you know that this is a legitimate debt for which they are calling you, you need to pay off the debt soon so that your credit ratings show some improvement. Accounts in collection are a negative remark and you need to take active steps to maintain your financial worthiness.

I have a medical bill with Mid South Credit Bureau and have payment arrangements for $50.00 a month. I still owe $308.00 and they called today and told me I have to pay either check by phone or credit card by 5:00pm. I have never been late on this payment. It has always been on time. Renee claims there are no arrangements in the computer for $50.00 a month due by the 15th of each month. My question is, beings payment are being made each month, can they force me to pay the bill in full immediately? Before I found this site and learned things, We had a verbal agreement. They never send a statement, they call state the amount and set payments and payment due dates. If I knew then what I know now, things would have been handled alot different. I would have made them put the agreement in writing.

My husband received a letter from a CA stating he owes money on an account that we paid a couple of years ago. He found the cancelled check and original letter from the CA. The funny thing is it's the same collection agency. He received a call from this lady a couple of weeks ago. He asked for information in writing. He told her this account was paid but she claims that he probably had two accounts. I don't think so. We're going to send a DV letter to the CA within the next few days. The letter is dated Dec 28th but it wasn't mailed until January 7th. Does the 30 days start from the date of the letter? Also, should we sent a copy of his cancelled check and other letter? Or wait for the reponse back from the DV letter? I will of course send it certified mail.

Creditors usually don't force to make the full payment unless they realize that the person can impose threat by defaulting on the account regularly.

Since you have kept the account active every time, I can only assume that they are trying to get the full money in short time. Basically, they might be insisting you to make a larger payment than what you are offering now.

Keep in touch with them so that you have updated information about your account. I can only understand that their is no legal harm if you are not able to pay the amount in full.
