But - now NCO started calling me last week declaring that THEY are authorized to collect on this account. They claim that as of January 4th they 'received my file in their office' and they claim if the prior collection agency continues to take payments from me they are acting illegally.
I called AmEx twice Friday. Both times they stated that they turned the account over to United Recovery on Sept 8, 2009. But that conflicts with letters I received from AmericanExpress dated early 9/8/09 and 10/5/09, which stated that the account was with Zwicker and urged me to make payment arrangements with Zwicker.
Next I called Zwicker and they did not relinquish their claim immediately, even though I told them that I had spoken to American Express. They said they are checking into it and will call me back tomorrow.
The worst thing is that I have gotten conflicting advice from AmEx. The first phone call they said that NCO has the account. The 2nd time I called they said that I should not miss a payment to Zwicker until Zwicker drops it. I asked them - can't you call Zwicker and tell them to stop collecting from me? they said NO, that I have to work with Zwicker myself.
I think I need an attorney
For sure I need an adult beverage :?
Anyone have advice to give on what to do when 2 CAs both claim to have the debt? I mean, I could ask for a debt validation letter but tomorrow AmEx could assign it to someone else......so what good is a DV letter in this case?
Help!

I'd have asked validation from both of them. It may be the case that Amex has only assigned the debt to these collection agencies. Hence, it's changed hands. But you need to make sure that you're paying the right party and the debt wouldn't come back in the future to haunt you. Get everything in writing from the CA.

two agencies can't collect - same debt. you need to contact the creditor and find out whose is supposed to collect or have they turned it to another agency? as said above send dv to both. you can also dispute it.

AMEX is dropping the ball on this one. Personally I wouldnt be paying anyone until they get their act together. And document everything that has happened.
how to stop ACH pmts?
I would love to stop paying Zwicker but how do I do that? I set up automatic payments to be deducted from my bank account. I've heard those are hard to stop. If Zwicker persists this is going to be tough.

Did you give them actual check numbers or just give them permission to deduct via ACH? If it's the latter, you can simply revoke ACH authorization. Send them a letter stating such via CMRRR. Also notify your bank that you've revoked this authorization as of the date of the letter.

I looked at the first payment that cleared and it is a check that they created with a check number. It looks similar to one from my bank with the routing number and acc't number across the bottom.
So I guess it's not really an ACH?
How do I stop them from writing more 'checks' against my account?
