What is the name of the payday loan lenders and what state are you in? If we find out whether they are unlicensed lenders it will help us, to help you more. Any legit company would not behave this way, you need to report them to the FTC (link in my signature), but you need to give details about the incident.

For example, if this person moved and the debt collector has been unable to locate her, then they are within their rights to contact other people trying to find her. Of course, the threats they made to that one person about how she would be liable if she didnt tell them where to find the debtor, now thats illegal all day long. But before you contact the FTC, it is a good idea to have all your ducks in a row. The FTC might not be so interested if you show them a violation, but if you get all the info together and can show them 10 violations instead of one, that might draw a more appropriate response from them.

OK, here is what I found out...as finally I got a phone call today. The place is coleman, connely and crane they reprisent the CMG Group. I have no idea how they got these other peoples numbers, yet decided to wait until last to call me? Any ways, yes I did have bank fraud and did have an unauthorized deposit in the amount of 600 dollars which my bank returned, since I had no idea what it was. They continued then, to draw on my account for a debt that I never incurred. The account was closed. I did not speak to anyone live, but this is the information I had on the message and I know this is who called my ex-sister in law and probably the ex wife. Although she stated that they told her that I was running a scam and involved in fraudulant activity and that she could be in serious trouble, subpoenad etc.etc. and ultimately responsible for the debt.. Well...if that is the case, send me the papers. I have always requested all debts be validated iin paper. I will never, ever pay anyone for anything I am not sure of after my identity theft.
So, should I call these criminals? I really do not want them calling my Mother and scaring the crap out of her, or my boss or anyone else! I know this is the embarrasment tactic collectors rely on to get your attention.

Well, I finally got the phone call. This is Coleman, Connely and Crane representing CMG group. CMG group is the precise reason I closed my account. I had an unauthorized deposit from them, which I had the bank return. They then drew payments of 90 dollars repeatedly for a loan I never received. I closed the account, had identity theft as well...I believe from applying for these loans.
I know this is the person who called my ex-sister in law. I am assuming the same for the ex-wife of his. Both of them stated that the person claimed I was involved in fraud and a scam and it was very serious. Although the ex-wife claims they told her she could be in trouble, subpoenad and responsible for this if she did not give them info, I am not sure if I beleive her completely.
So, now do I call them? Will they continue to harrass any and every person ever associated with me using scare tacticts? I will not ever pay a debt that is not validated on paper and why on earth do people get scared of these scum bags? I don't want them talking to my Mom.

Well, I do not owe them a thing! I have asked all my lenders for validation in writing. I have no e-mails or phone calls from them until now. How do they justify calling and threatening people I don't even associate with? I am sure it is to embarass me and get me to call them. I think I will call this lady back and advise her to validate and show proof of claim on this debt in writing for my attorney. We will see what they have to say then.

I would want to show that there was an error made, and that the bank kicked the money back to the lender ASAP, so that there will be no doubt as to what happened. Keep this in mind--to a debt collector, everyone they call doesnt really owe the bill. So many people say that, even if they know they do owe it. So telling them that will do nothing for you. SHOWING them that, now, thats another story. I would contact the bank and see if you can get those records, and then for now keep them to yourself. Also, when you talk with this debt collector, it isnt enough to tell them on the phone to validate the debt. You must do so in writing. Send them a certified letter telling them that you hereby dispute this alleged debt, and that pursuant to the FDCPA, you are informing them that full and proper validation of this alleged debt is requested. Let them try to validate it. Depending on what they come back with, you might just catch them breaking laws in the process. One more thing--check your credit reports ASAP.
