My employer sent out a letter to IPS and told them they could not garnish w/out a court order, well now IPS is telling me they are going to hand my file over to their lawyers to garbish my wages ( i owe them $100.00 on $200.00 loan) They do not want to take the amount that I owe, but they are willing to settle for $275.00. My question is can they garnish my wages?


Which payday loan company did you borrow from?
Was it a storefront location or an internet loan?
What state do you live in?
How much did you borrow and how much have they taken from your account to date?

They can't garnish you without a court judgment. However, it's likely there are some steps you're going to need to take to protect yourself.

their lawyers would have to take you to court and win.i doubt they can do that.an illegal collector collecting on an illegal loan won't set foot in a court of law.i wouldn't worry,but if they try to pas a phony document i would look to sue them then.
