Just remember that even if they do actually serve you, you can go to court and fight it! The burden of proof is on them if you fight and demand they prove it.

If they say a process server is coming out to you say, "So what? You want to take me to court over an illegal loan? Good luck with that..I will happily see you in court."

If they threaten to come to your house or office, I have experience with this! You simply tell them they are not welcome and will in fact be trespassing. If they do show up, tell them to immediately remove themselves. If they do not, call the police....THEY will be issued a trespass warning! If they come back again after that, they GO TO JAIL. I have done this myself when a company kept coming to my house trying to collect.

Got a call from this number this morning. On a unlisted unpublished number that I have NEVER given out. Bill Turner called wanting my grandmother he gave that same number and it go's to the ban group he then called my main line number and even went so far as to say "I was faxed a copy of a summons to serve for charges" then he disconected the call No numner on caller id except 000-0000. My grandmother had a payday loan after my grandfather died to help with cost's. It was a storefront and she said it was paid off as I drove her there. After I talked to them a second thime the manager I got said the birthday on that account was Sept. 27, 1981 for a 28 year old and my grandmother is 89? Now that is funny. I was told that even if it is a storefront they can't file criminal charges against you it was in 2007 and it was turned over to a collection agency. My grandmother is freaked and the fact that her sister passed away yesterday dosen't help her. We are in Florida. Check-N-Go

This company called me this morning also saying the same thing. Come to find out not only is the Bam group NOTan attorneys office like thetold me, another company called P&B Capital claiming that I owed on two loans and not one charged me $488. So now I have to get my money back from them as well. TIPS: If you have the actual account number from your loan ask them to give YOU the account number DO NOT give it to them if they cant give you the account number they are a fraud!!! Ask them to send you a verification letter proving that youowe the loan.

I too have taken out a Payday Loan yes loan...unfortunatley. I have tried to pay the $400.00 back and made 2 "good faith" payments to them with a "prepaid" credit card. Due to some unforseen medical expenses it has been very difficult to even by groceries or pay my utliities. I will NEVER take out another payday loan! I am been bothered numerous times daily with threatening phone calls that I am being served a summons to appear in court, that they are coming to my place of employment and making threats. I have returned their calls and asked them please to not call me at work and I always return their calls. They keep telling me that they need a recorded agreement with me on the line giving them a formal payment arrangement. After seeing these posts after doing a search, I confronted the man that keeps calling and told him that I want something in writing from their company mailed to me with my balance. I told him that I will mail them a money order and assure him that I will take care of this. They also left a threateningmessage with a coworker stating that I need to have an attorney call them. I have been trying to work with them but they will not take a money order mailed to them. Can anyone please advise me as to what to do next. Can they keep calling me at work and leaving those messages when I have asked them not to? Can they refuse a money order from me? I am a good person and have good intentions and pay my bills. I just am overwhelmed with some medical problems and this added stress of them calling me all the time stress me out even more. I appreciate any input anyone could provide to me. I live in Michigan and I took theloan out over the internet. Thank you in advance.

Legally, no. They can't.

Relax, bud. Your intentions are not under discussion here. We're on your side in this, because we know how these scum operate.

Now then. Advice... But for the fact that they're harassing you at work, the easiest thing to do would be to simply hang up, and keep hanging up until they get the message. There's nothing they can legally do to you. And they know it. That's one reason why they resort to illegal tactics of fear and intimidation to try and get money outta you. Your account of their calls reads like a laundry list of every prohibited tactic in the FDCPA.

Normally, I'd advise recording their calls as proof of their illegal tactics, but you're in Michigan. That's what's known as a 'two party' state, meaning that you need the collector's consent before you can legally record the call. Bummer...

Next time they call, answer the phone this way:

"Hi there. By saying anything at all, you give your formal consent to have this call recorded."

They'll probably hang up before you can finish the script. If they don't, then they've consented, and you can then record them legally.

While you're waiting for them to call you back and give you a chance to try out your new script, it's a great time for a little web-surfing. Go to the Michigan Attorney General's website, and file a complaint against these idiots. Then head on over to the Federal Trade Commission's site and do it again. While you're at it, download a copy of the Fair Debt Collection Practices Act, the federal law that dictates what collectors legally can and cannot do. Read it, and learn what your rights are.

And if you need more help, holler. We'll be here.

to be honest, a letter with your balance is not exactly proving that they can collect on this debt. do not send them anything until they put in writing the balance that you legally owe (do not trust them on this amount, do your own research) and their word that they will accept money orders sent to a physical address. send them a C& D letter, demanding them to stop calling you at work and for all communication to be written.

They are Bayside Asset Management Group and they are scam artists. They call everyone and tell them that they are coming to serve court papers on you and if you are not in court, then you will be arrested. They are blowing smoke up people's butts. I basically told them to take a hike if they could not produce the paperwork to me by fax. They threathened to come to my job and my home and I told them to come on. They have made multiple threathening calls so I called my state's finance commission and the calls have stopped. Check your state laws on payday loans. There is little that they can do to you.

My husband received a call from a group called Allstate that was bought out by the Bam Group. They were very threatening saying that they were taking us to court and how we desperately needed money so bad we wrote bad checks. This supposedly happened in Nov. 2008. They said they did not have to provide proof of the debt. My husband has already arranged payment with these people and we had to close our account. He agreed to two payments of $85.00 each. The first time they sent through a charge for $587.50 and the second time was $200.00. I have opened a new account and now they are saying we have 3 bad checks against us. The lady's name was Ms. Minks. She would not give us an address of where they were located and said that my husband would be served the summons at work. I told her that I would have my lawyer to call her and she said I didn't have a lawyer because I didn't even know how to say the word. She also said that they can talk anyway they want on the phone because they do not have to go by the FDCPA. My husband is worried even though I have told him that this is a scam. These people are relentless. I have reported them to the Fair Trade Commission and I have a report headed to the Attorney General's office. I am just hoping they do not cause my husband his job by calling his employer. Do you have any advice for me?
