Debt Validation Question

Why would a PDL NOT be able to validate a debit? Is that because they are not licensed in our state to do business? Or will the validation they give me only be for the principal amount of the loan?


Debit or debt?

You may need to offer the following information in your next post.

- Name of the residing state
- Name of the lender
- Type of the lender: internet, storefront
- Amount borrowed
- Amount repaid

By the way, debt validation doesn't apply to original creditor.

I sent a validation letter to an attorney that is collecting for from an illegal PDL. That is why I asked the question. Everyone here states that when you send a validation letter you generally don't hear back from them. So why is that, is it because they are not licensed in this state, and if that is the case wouldn't they then validate the date for the principal amount only?

Usually, the reason why illegal lender's who assign 1's or collection agencies can't validate the debt is because they don't hold the documentation required. They are also betting on a debtor not to request validation (because most don't). They wouldn't have the nerve to walk into a court of law without documentation and no real law to support their case. On the other hand, they hope that you as the debtor do not understand and know your rights.

If they contact me by email regarding the pdl should I be sending the PDL a debt validation letter, or only if they send it to a collections agency? Also, most of the emails they are sending me indicate a collections department from the PDL company, should I be sending them debt validation letters?

I just had an encounter with First Source Advantage LLC and I post dated a check to them. I did in hopes that my boyfriend and I could get his credit straighten out with Capitol One. I had a bad feeling about the company and went on line to research them .. It wasn't good. I have placed a call to put a stop payment of the check but Bank of American told me it would not be effective until Jan 20, 2010. My questions is how do we get to the bottom line , who do you pay to be sure it gets credit the correct way.

You should first ask them to validate the debt. Did you ever receive a letter of collection from them via the mail? Never agree on anything in a phone conversation, you never know for sure who is actually on the other end of the line. Get it in writing before you submit a payment to anyone.

The first letter of collection from any collection agency or collection attorney should include a mini miranda warning, which states somewhere on the letter something to the effect of:
This is an attempt to collect a debt from a debt collector, you have 30 days to dispute this debt and request validation.

After receiving said letter, you should dispute it within the 30 day period, for your own best interest. This way the collector must verify who the original credit or is, and some type of proof from the original creditor that they are authorized to collect the debt.
