i got terminated from my job in sept30 my pay was being garnished when i file income tax will it be taken?

Tax return can't be garnished for credit card debt. But if the creditor puts a levy on your bank account and tax return gets deposited in it, then the money can be taken away by the creditor.

I think it also really depends who got a copy of the judgement. If your pay was being garnished prior to termination, I am assuming there was a court judgement involved telling your employer to take the money out of your paycheck before it hit the bank.
A tax refund is deposited directly into your bank account, which may or may not have gotten a copy of the judgement. I would ask to see a copy of the judgement from the court, first-and if money has not been coming out of your bank account in the past, possibly you are OK? A copy of the judgement would specify how the creditor is to get their money--whether directly from the employer or your bank account. Just a thought.
