ca on credit report during validation process

Correct me if I'm wrong, but A collection agency isn't supposed to report an account to the credit bureaus while it's in the verification process right? Because I see that nca has put something onto my report, but before that I had spoken with them and the guy there told me it was still being validated. So how could they report me?


Even though the debt is not valid. Along with the dv letter i also sent them an email from the pdl showing amounts i had paid them, which is much more than what the original pdl was for and per ny laws is all I'm required to pay. So therefore the account is paid in full. Would this be something that I could dispute with transunion and equifax?

Also does anyone have a link to sample letter I can send them asking to have the item removed from my report. It's getting close it having been 30 days and I haven't gotten anything back from nca. when I last spoke with them they told me the account was being verified and that they were waiting for paperwork. If i don't hear from them can I have it removed?

I think I read an opinion on this at the FTC website. If a consumer disputes a debt in the 30 day window it could by chance end up on a credit report BUT has to be reported as disputed. If you dispute the entry with your credit report and have not been sent validation yet that is when the law is broken.

It is the 1-2 punch and can be very effective in a lawsuit against a debt collector.
