Need Help! Already Paid off Debt. New company involved.
Date: Wed, 01/20/2010 - 08:14
I had a Bally Total Fitness account I stopped paying. I settled on a $1478.35 default for $500.00 with some company called SEARAY PORTFOLIO MANAGERS, located in Buffalo, NY.
This was back in September.
I just received a letter in the mail from NATIONAL CREDIT ADJUSTERS, located in Hutchinson, KS. It states that I now owe them $1478.35.
The only proof I have that I paid the $500.00 is my bank statement. The SEARAY company never sent me a receipt for debt paid off.
I need help with wording a letter to NATIONAL CREDIT ADJUSTERS stating the account has already been paid off. And that it is their fault for buying an account which has already been PAID.
Any help will be greatly appreciated...
Thanks,
Kevin

I would simply send them a debt validation letter. Make them prove that you owe the amount they are trying to collect.

Dear ________,
This letter does not imply that I refuse to pay this debt. Rather, I dispute your claim according to my rights under the Fair Debt Collection Practices Act (???FDCPA???). I am also afforded the right to request a validation of this debt and am requesting such proof now. Please supply me with proof that I am indeed the party who is, by contract, obligated to pay this debt and validation of the amount your company claims is due.
I assume you are aware of the fact that until you validate this debt, you can neither continue collection activities nor report this information on my credit report. I am sure your legal staff will agree that non-compliance with this request is likely to put your company in serious legal trouble with the Federal Trade Commission (FTC) and other state/federal agencies.
Please attach copies of the following documents with your response, which I expect to receive within 10 business days of the date of this letter:
1. License # or other proof of your authority to collect debts in the state of ____
2. Agreement with your client (the original creditor) that authorizes you to collect on this alleged debt
3. Verification of all data regarding the establishment of this trade line including the applicable signed origination papers that allegedly contain my signature
4. A line-item debit and credit summary of the account???s history
Further, I demand that you cease contact or attempts at contact with anyone other than me or the original creditor regarding this alleged debt. I also demand that any further contact with me be made via Email or US postal mail only. Failure to provide such validation or disregard of my request for Email or US postal mail contact only will abridge my civil rights.
Thank you in advance for your cooperation regarding this matter and for protecting my legal rights in accordance with federal and state consumer protection statutes.
Very truly yours,

At the same time, you need to contact the debt collector you paid the money to and inform them that they agreed to this settlement, and now they need to provide the written proof that you psid the agreed-upon amount and that the matter is now settled. If they refuse to provide it, inform them that you have everything on your end documented and that you are prepared to proceed with further action, including legal action if need be, to get them to hold up their end of the agreement.

In regards to this situation you need to get in touch with them
In regards to this situation you need to get in touch with them & asking for proof about your debt what they are demanding from you.If they don't provide you with relevant information, you just inform them that you have all the proof in your hand & you can go for any legal actions against them in future if needed,& wait for their reply..If they are genuine then they will come up with a positive reply. But if they are fraud, then they will not have any way to defend themselves!!!!
