Bank account garnishment, please help!

Hi, a few months ago I recieved a small claims notice for an amount I owed on an old credit card debt. At the time, I had started a new job and was making more money than usual. So I entered into stipulation with the creditor to pay off the debt on a monthly basis. Well, about 2 weeks later, the company I worked for went out of buisness and I lost my job. So needless to say, I was not able to pay that monthly payment. Luckily I started a new job not too long after being laid off. Well today I looked on the state I live in's Small Claims site, and it says that a bank account garnishment was filed against me. I currently have no money in my account. In fact, my account is negative. What I want to know is, will they put a hold on my account for the amount I owe? Or is my bank account left alone FOR NOW. I know they can try to take it out again in the future, or garnish my wages, but I just want to make sure that they didnt put a hold on my account for the amount I owe. Can they do that? Or would they normally just take out what I have in it on the date of garnishment to satisy some of the judgement?


Boy, do I wish I had something good to say. Once you get into a stipulation, you're in a binding, legal contract. You screwed up. Look at your stipulation and see what it says they can do. They're gonna do it and there's nothing you can fight it with. Talk to a lawyer.
