Okay, normally you have thirty days after the initial contact by the collector to ask for validation. After the time period it would be assumed that the debtor has agreed to the debt.

Unless they send the "initial contact" by certified/registered mail I don't know how they'd prove that they notified you in the first place.
In other words if they notify you by certified/registered mail then you have 30 days from that contact if they don't then you can validate any time you wish.

I was served papers. Account is in my husband's name, but paper
I was served papers. Account is in my husband's name, but papers were served to me. Don't know if this makes a difference. I'm not even shown on his account. Anyway, I spoke with the attorneys several times regarding the account. We've tried to come to an agreement, but we never get there. I'm looking for a letter and 1099-C that Citibank sent me claiming the account was settled, but I can't find it. The attorneys (Hunt and Henrique...lovely group of people) say they don't really care and want me to pay up the original amount prior to the settlement that Citibank worked out with me. Unfortunately, Hunt and Henrique is buying up all of Citibank's write-offs and trying to make millions on it. How can I get another copy of this 1099-C? Does speaking with them several times since they sent me papers count for anything? I guess I can't prove I spoke with them and they can deny speaking with me? They claim if I don't send them $5000 by the end of the week they are going to see me in court.
