First of all, never admit to owing a debt over the phone! Next, tell this collection attorney that he/she now has 5 days to send you a dunning letter (letter of collection) in the mail as required by the federal law (FDCPA). If he is any type of legit attorney he will already know this. Do nothing until you receive a letter of collection in the mail, and once you receive this letter, the FDCPA says a debtor has the right to request debt validation from a collector within 30 days of receiving a dunning letter! So, send them a debt validation letter certified return receipt requested as soon as you receive a letter of collection from them! MAKE THEM VALIDATE the debt! Until then and after you speak to them again and let them know your rights^^ don't talk to them on the phone again, hang up.
Things that make ya say 'hmm...'

I understand he wants his money, but i don't have it until tax returns, can he tell me to borrow it or make comments to me like the one I mentioned?? I hung up on him and he called back several times leaving me messages to pay by the next day or else face charges. I tried to work it out with him but he wanted the moneythe next day and I don't have it or anyone to borrow from. Please help me. I want to pay it off but not tomorrow. Kim G:confused: |

A collection 'lawyer'??? Fancy that. I'd think a real attorney would know better than to step on his lips like that. Did he give you his name, etc? If so, look him up on the Bar Association website for whatever state he's in. Or, throw us the name and state, and one of us will pry into it for you. This sounds like a sleazy collector who's putting on airs of respectability.
Save those threatening messages! And save anything else you get from this clown, paper or calls. Based on what you've posted here, you have him on several violations of federal law (FDCPA). Myself, I wouldn't pay the bastard a dime without strict validation. Maybe not even then. If he wants anything other than an FDCPA suit, he'd better learn some manners, real quick.
i agree. do not pay them a dime unless they validate and give yo
i agree. do not pay them a dime unless they validate and give you a physical address to send money orders to.
