Hi, I had to file personal bankruptcy in 2006 after a bitter divorce. Anyway, Now, I'm planning to start a business venture for which I'd need business loans. However, I am worried that I'd be denied of credit because of the bankruptcy.

Is my fear true? Would I be denied of a business loan because of a personal bankruptcy? What can I do to get the record removed from my report?

Thanks in advance for any suggestion.

"Business Loans" are not subject to Regulation B (Equal Credit Oportunity Act), and so a bank really can turn you down for any reason they want to.

In the bank's eyes, a bankruptcy is an indicator of a person's ability to handle their finances. If you went bankrupt personally, then the bank may predict that you might run into the same problems handling your business finances.

In this economy there is definitely a credit crunch, and banks are not so willing to grant loans - especially business loans. Just for example, my company has been in business since the 1950s and never had any financial problems. We have been in business negotiations for over a year to expand one of our lending programs nationwide, which would essentially triple the size of our business (and our profit). But we need capital (loans) to do that. Simply because we have some secondary paper (sub-prime loans) on our books, no bank will touch us. Which is okay, we have lots of private investors. But essentially what I'm getting at, is that the banks are looking at my customers' credit, and refusing to give us a loan because of how well my customers pay their bills.
