I've done some research online but am still a bit confused. Hopefully someone can help me.

On my credit report, there is one account that was sold in 12/2006 to a collections agency who is now attempting to sue me (however, their representation recently filed bankruptcy so i'm not sure what is going to happen). My claim has always been that the SOL has expired, therefore it's a time-barred debt and I cannot be sued. The last payment, according to my credit report, was March 2006. Forty-eight months of payment history is listed on the credit report. April of 2006 shows a 30 day delinquency which would make the last payment made to be in March 2006. The trend of 60, 90, 120 continues through to July. However, in August, it jumps back to 90 days followed by Sept - Nov which shows 120 days. In December (when the collection agency bought the debt) it shows 60 days delinquent.

I am certain I made no payments to this card after March. So, can someone please explain why the payment history jumps from 120 to 90 days delinquent, then back to 120, then back to 60 the month the collections agency bought the debt?

Also, it is my understanding that the collections agency "date of removal" should be the same as the original creditor. In this case, the originial creditor shows a date of 1/13 and the collections agency shows a date of 5/13. Isn't this incorrect?

Thanks in advance for your help!

Yes, you can't be sued for a debt that has passed the SOL. IMO send a cease and desist letter to the collector. Even if they sue you, they would have no legal leg to stand on. You can easily get the case dismissed.

And, hang tight someone would shortly be along to address your other issues.
