I called Chase back on my 2 accounts today, coming up on 90 days, and they told me that it was in pre-litigation. In a few days it would go to an attorney for a summons. They offered 75%, and told me that if I refused I could not counter-offer - for either account.

This goes against everything I've read and researched on this DS process I'm been getting. Has anyone else been seeing this? Are they just trying to scare me into an early settlement?

I gotta tell ya, this site helps calm my nerves about all this, knowing others are going though this, but this makes me nervous.

Thanks for your help.

Hey all. Coming to 150 days and no deals better than 50% with Chase. I was given the number of the local instate attorney to discuss. Has anyone actually been sued by Chase before 180 days? Any experience settling with the attorneys? Do I have to give out any extra information like employer or income?

Sweating it out.

Thanks

Hey, Yup been there done that. Our first settlement actually came a bit quicker than we expected. IIRC, day 60ish Chase threatened to sue and said although we're not supposed to do this, they threw out the name of an attorneys office they said it would go to. Day 65ish, got a letter from the local firm approx 10 miles or so up the street...I googled the firm and they were/are nuts, they had 26 pending federal lawsuits and alot of crazy stories as well. I thought what did I get us into? We called them and made our 1 and only offer, balance approx 9200, offer 2750 lump, they atty balked and siad that would be a good start for a 1st payment, we held firm, atty said it's too low and Chase would never accept that, we countered with are you refusing to present our offer to your client? It was presented the following day and Chase accepted. So yes you can resolve with a local firm, but yes they will want to get into your personal info, They probably have looked at your credit report as well, If they know you're working and getting a paycheck as opposed to self employed I believe they're more likely to sue. We didn't tell them much and were vague, out of $ and also pulled the BR card...Depending on your balance and if you really get the impression their gonna sue you electing arbitration would stop the lawsuit...best regards
