Help dealing with Wells Fargo Auto Finance ~ 86 days past due but made 2 recorded payments in three weeks
Date: Thu, 02/04/2010 - 21:06
My loan agreement ended in November 09 but worked out an agreement with Wells Fargo Auto Finance at the end of December for a loan reschedulement. I was to get the paperwork in the mail by Jan 1 and I had to return the paperwork by Jan 7. By Jan 4, I had not received the paperwork. I called and the operator said that the paperwork would show up in the next few days. It showed up on the 11th of Jan and they sent the paperwork to my old address (from over a year ago). I only got the past due letter because my neighbor (in my old duplex) said that I received mail from Wells Fargo. I called again and the same operator said that it was their fault and they would reissue the paperwork. Another week goes by and nothing, I call the same operator who said the paperwork was sent out on the 14th and I need to call back if I don't receive anything in the next few days. I made a payment and said I would call back in a week or so. I call back on the 20th and she tells me that I was denied the reschedule because I was over 60 days behind (60 days would have been 8th). I told her since I just made a payment, it should only be less then 40 days behind. She goes on to say that since my original loan ended, it would not drop down by 30 days if I made a payment and would I like to schedule another payment to show that I am catching up on my total balance (which was a little over $1000 at this point). I schedule a payment for Feb 3rd and made the payment on this day by Western Union. I ask if they are going to repo my car and I am assured that as long as I keep making a payment every two weeks.
I receive a call today from another agent telling me that my car is going to be repo'ed if I don't pay off the total balance of 8XX.XX in the next 4 days. I told the agent that I made arraignments with my usual agent to make payments every two weeks and she transfers me to a Senior specialist. I tell this agent the situation and she said she is going to place a hold on the account so it won't go to the repo department and to make my usual monthly payment next week.
I have this feeling that they will come to get the car regardless of the supposed hold on the account but I can not get $800 in the next four days. I'm going to try and get an auto refinance tomorrow but I highly doubt it will work. I have no one who can co-sign or lend me the cash and I fear that I won't be able to keep my job since my car is required.
Does anyone know how I should handle this? I had a few ideas:
1. Get a auto refinance; this is unlikely since I owe less then a $1000 and my credit score is in the mid-500's.
2. Store the car and borrow my roommate's car during the day for a few weeks until I can pay this off? Again highly unlikely since my roommate won't let me drive the car when she is in it.
3. Couch surf at friend's house for the next few weeks since they do not know where I work.
4. Last but not least, Claim bankruptcy to prevent them from taking my car but ruin my credit even worst and my total debt from the last 7 years in $4000 not including the car
Any suggestions would be extremely helpful.

Hey Dentond,
Have you tried speaking to a manager at Wells Fargo? Often the customer care representatives don't have sufficient (for that matter correct as well) information to give to the customers. Hope you have recorded statements of the two payments that you have made to the lender.

As someone who has had some financial problems, I TRULY think Wells Fargo is the WORST company with which to deal. Their right hand does not know what their left hand is doing. They are rude and inconsiderate. They are probably the worst company with which I have had to deal.
