Ok - having said my roundabout thank you - here is where I'm at in your extremely well laid out plan :D:
Step 1: Close bank acct - have been to the bank, pulled all money out of cking acct, unable to close because of pending items, requested hard debit block on acct and explained situation to branch mgr who said he would support me and work with me on any reversals or NSF charges that might occur in this process.
Step 2: Prepared spreadsheet.
PDL name/orig loan amt/orig payback amt/amt paid to date
ACC - now CCS (I think): $400/$500/$645 - up by $145
US FastCash: $400/$520/$1,150 - up by $630 (and this is on 3rd loan)
Cash on Wheels: $200/$357.50/$1,887.50 - up $1,530
Payment Direct: $200/$289/$178 - owe them $111
Solomon Finance (Pay1Day): $300/$390/$360 - owe them $30
I looked at the next 3 a bit differently:
PDL Loan Center: $300/$390/$0 - *See below
OneClickCash: $450/$585/$0 - *See below
Paycheck Today: $500/$650/$300 - *See below
* My first thought on these three is that I need to do EPP's on these as they are valid loans (I received the money) and I am obligated to pay back my debt - no problem! Then I started going through my bank records and putting the information in my spreadsheet and I realized that:
PDL Loan Center: 3 loans since 07/09 - $950/$1,235/$1,220 (I should only owe them $15)
OneClickCash: 3 loans since 07/09 - $1,200/$1,560/$2,275 (they owe me a refund of $715)
Paycheck Today: 3 loans since 04/09 - $1,300/$1,690/$2,705 (they owe me a refund of $1,015)
The only reason I am breaking these three out is because they are the most recent loans and while I feel obligated to pay them back what I borrowed, I don't believe that I should have to pay all of the money back since, in theory, I have already paid back these current loans...some of them twice over.
I now feel ready to move on to revocation letters and ultimately C&D letters and thank you all for the examples and templates.
My questions:
1) California: does anyone have the regulations - these are all internet loans. I thought I read somewhere that rollovers are illegal in CA and that there is a cap on the APR (although with the majority of these I couldn't tell you what the APR was if I wanted to - but I am interested in this because of CashOnWheels which has been in my account for over 1.5 years for a $200 loan and I would really like to try and get my money back from them!!!)
2) I read over the majority of my "contracts" and saw that revocation of ACH needs to occur at least 3 business days before the next payment is due. My next pay date is 2/17. Should I try to notify them today (send by email) or does that point really matter? I would just prefer to see how things go next Wednesday with my account before I start freaking these people out and open up my phone to psycho-ring for the next few months.
3) On the ones I wish to do EPP's with - should I contact them before my next paydate is due or default and then call them to set up EPP's. My concern being, if I call today and tell them I can't make my next payment, will they try and go in and take all that's owed even if they set up an EPP. My bank did concede that my account could be re-opened due to the timing of my actions and I don't want to deal with reversals and NSF charges (the bank says they'll work with me, but they might not be so willing if there are $1,000's of dollars involved).
Sorry to be so long winded, but the prospect of getting out from under these folks is extremely exciting and invigorating! But in my excitement I want to be sure that I am handling all of this correctly to ensure the best outcome and not make matters worse for me (although I don't think they could get much worse!!!!).

Notify your financial institution, not the lenders, if you notify the lenders they will attempt to go in and withdraw massive amounts of money from your account.

Don't attempt to do EPP's with any of them as none are licensed, the only exception is ACC or CCS, I am uncertain who they are, they may be legal lenders or they may not be, I need to know the entire name.

Ok - I have completely read back through your responses thoroughly and have another question. I have an existing loan with CashCentral and was going to call them to set up an EPP - they even discuss that as an option on their website if you're having trouble paying them. Should I go ahead and do that, or lump them in with all the others and just wait for the phone calls and nasty-grams?
