i had a pay day loan with e payday loans and i am now getting calls from the BAM Group about serving me some papers for court either at my job or my home, seeing as though i didnt write a check, can i be legally chagred with writing a bad check?


srsly, don't worry about these jokers. I got the same call not that long ago and turned it over to a lawyer. he tried without success to locate an address for them to serve them with lawsuit papers on my behalf for threatening a lawsuit. his conclusion- they are a total bottom feeder and can do NOTHING to you.

I just dealt with these characters for the first time today. Someone used my mother's phone number under false pretenses and evidently defaulted on a debt and they have been harassing her. I tried to call them and inform them, civilly, of this, and wow... what a bunch of belligerent a*****es. The would not give me an address and tried telling me that they are a call center and do not make outbound calls, so I must be a liar. As much fun as it was tearing into them, I need to end their calls. I told my mother to ignore them, but she stresses over the strangest things. Anyone who has their current address, some of them did speak with a New York-ish accent, gets 100 cool points and my eternal gratitude.

Friend Eso. This is the United States of America. Debtor's prisons have not existed for a long time. I don't think you can be incarcerated for a debt... unless it is unpaid taxes or not paying a fine issued by some type of government entity.

This happened to me today! Needless to say, it freaked me out. Literally, in tears. They first called and asked for address so I could be served. Then, gave me a number to contact BAM directly. I spoke with a woman who said I would be charged on 3 counts, including check fraud. I received a pay day loan, and was unable to repay it. I spoke to my lawyer but still feel nervous. I didn't write a check to commit fraud. I did take a loan and didn't repay it.. But millions of people do that. What about people who default on the mortgage? They don't go to jail! Are you sure that they can not take legal action against me? They even called me at work to speak to my boss about garmishing wages.

well to actually garnish they need a court order.in fact some states are non-garnishment.i doubt a bunch of sewer rats in ny can take you to court in your town,village county or bourough.i haven't heard of any instance except for shills who work for them stating anything but threats happened.if your boss knows their onions about these places they will hang up in their face.as that is what they deserve.

I got a call today telling me I was goingto be served at my place of employment and then given anumber to call to settle the debt. I spoek to a very ignorant fellow who told me that if i called back one more time afterhe rudely hung upon me that he was going to filecharges against me for harrassment. The first caller stated that she could come to mu place of employment with a police officer and serve me. Why does it always have to be your place of employment do they not know that if they cause you to loose your job they will be at square one "debt not getting paid". What can I do??

They are just trying to scare you. They are not a legitimate collections agency. As posted above if they were going to serve you, you would be contacted locally by a private process server or officer of law. I cant tell you what you should do in your situation but I told them exactly where they could meet me and no one showed up. They are phishing for information and are violating all kinds of FDCPA and FCRA laws. Don't fall for it. Check your states law concerning pay day advances. Many do not allow them anymore and as such they took a risk loaning you the money. I am still doing some research on this subject but I don't believe they can collect if your state has banned pay day loan companies.

THIS GROUP IS A COMPLETE SHAM!!!!!!!!!!!! I recvd the same phone call today from this group and was told the exact same thing as did the others above. Thankfully I have been a paralegal in the past and know how to "investigate" on my own, along with the help of a past employeer (an attorney). I myself was in tears in the beginning, nowing I had never gotten a pay day loan and informed this company that this was fraud on me. Needless to say, I too, dealt with 3 serperate ppl and welcomed this "summons". I called back a seperate time to inform them of the information I had recvd in regards to my investigation only to be hung up on. If I owed anyone money would they not welcome my willingness to give them not only my home but my work address so that I could be summons, go to court and (according to them, I was already guilty) they could get their money back???????? A collection agency does not work like this...trust me!!!! Take a breath and don't let them get the best of you. Think of it this way, were good ppl who pay our bills and know that we don't accept this type of behavior in our lives so they believe we'll just pay....but you and I know the real truth. I am speaking with this attorney and hope to stop this from happening to anyone else!!!!!

I don't know about all states but where I am from they can not serve you at work. It is a violation of your privacy. Second, it is against the law for them to threaten you or harass you. I asked for their address and local phone number which they would not supply. They do not like anyone who has a slight understanding of individual rights. All the lady would do was to keep hollering that my son owed the money. I asked to see the loan papers and was told that was not going to happen because he knew he owed the money. I asked her to fax me something showing this and was informed the fax machine was broke, yeah right. I told her we would see them in court. I know they can't file a claim with the court without evidence that it is legitimate.

I actually work at a place where they have claimed to do collections for us and no history of that info..so we have been warning consumers of that as well..they are bulls*** scam artist from what I can see..unless I hear something further,,
