I heard that these kinds of business' cannot take you to court if you don't pick the check up on time. I have a friend that was paying then $20 a week until she paid the check off. Now she is out of work and can't pay the remainder of the check. Can they take her to court?

It depends on whether it's a legal lender or not. If this was a storefront and she actually went in with a paper check, then yes, they can sue her. It's more likely, however, that they'll write it off and send it to a collection agency.

By the way, being rude to Shaz, who asked a legitimate question, isn't the way to get help here. Shaz is a well repected member of this forum who gives wonderful advice. When she asks questions, it's because she wants more information so she can give you the best answer possible to help you with your situation.

well,i'm assuming this is a storefront so yes they can take civil action.they can't use the criminal process,or threaten criminal action.a couple of questions.

who is this place
what state are you in
how much was borrowed,and how much was paid back so far

you see once she stops paying the interest and fees pile up,so they might wait before proceeding.the best bet is to keep in contact with them,and keep them informed.they could get a garnishment that could take effect once she does find a job.

OMG! I was JUST asking you a question, I wasn't doubting your word or your knowledge, I wanted to know what made you think this, as in, perhaps there was some legal reason why you thought that way, or perhaps someone else told you? For your information, I am here to learn also, therefore, I was ASKING you a question.
