wage garnishment %s?!

how many companies can garnish your check?? my husband's check is being garnished right now...can another company garnish his check at the same time? (can 2 or more companies garnish your check all at once?)

what is the highest percentage they can garnish from him?

now that he's filing for bankruptcy, can they stop garnishing his wages?


its not me who's being garnished. its my husband's.
a payday loan called cash america...i believed its those superpawns. and my husband told me recently, the HR at his work called him, letting him know he's got another papers to sign..he told me its another garnishment papers, but didnt tell me which one.

im just curious though how many pdl companies can garnish your wages, can more than one garnish your check??? and what is the highest percentage they can garnish from your check??

It can't be a garnishment unless it's already been through the court and they have a default judgment against your husband, if this never went through the court system what they may be talking about is a wage assignment, which is totally different than a garnishment. Most payday lenders put a clause in their contract which states if you default on the loan you give them permission to impose a wage assignment, however, that is revocable at any time. All your husband would need to do is send a letter to the payday lender which says he revokes their right to any wage assignment, then take a copy of it to his employer and that's the end of it. It's a federal law, his employer must adhere to your husbands wishes and not give any of his wages to the payday lender.

As far as garnishments, it varies from state to state, usually only one garnishment at a time can be imposed and it's usually 25% of the wages.

i remembered we received a mail back in 2008. that he'd got court hearing. BUT he never showed up we never got the mail letter til february 2009. and around august 2009, there some marshalls looking for him at his workplace even to my parents house. and weeks later, his general manager sent him to hr because the hr asked for him that he needed to sign some paperworks its rgarding garnishments. and now his check is being garnished i believe from cash america(superpawn). as if we have no other choices/options. he filed for bankruptcy. now he's check is being garnished.

he never showed up in any court hearing etc. just a letter thats like past due. and then marshalls come lookin after him. they even showed up to his workplace. he ended signing up paperworks and now he's got wage garnished;(

will we ever be notified if that lender is fully paid? because we dont wanna be like not knowing anything, his being garnished stil and then its fully paid..will we be notified if its paid off already??
