Hi there,
I recently posted a question about Care Credit and their lending practices and horrendous interest rates. I became delinquent with my acct. almost immediately. They sent my bill 7 days past the due date and then proceeded to charge huge interest rates that made the payment impossible for me to make. Fast forward 2 1/2 years. I have had exactly one phone call from one collection agency regarding this debt last June. I told them I was unable to pay the full amount ($2950). Never heard from them again.
For the last 3 months I am receiving daily or several times a day calls from this law office listed in my title on behalf of the collection agency who took over the Care Credit debt. They are listed as being located in Ohio while I live in MI. Last week I received a letter that looks like a judgement signed by a PL here in Mi with the law office name on it. It isn't a judgement but looks like one and a threat of one being filed against me. Then I had a phone call 2 days later from someone in that office saying a judgement has been filed against me. I told him I sent a return receipt letter to their office requesting the debt validation. That stopped him cold. So far I haven't heard anything. My questions are: how do I find out if these attorneys are registered to practice in MI and how should I proceed from here?
Thank you so much for your help!

Juiij,

There is no Federal requirement for the collection agencies to be licensed in the state. However, some states have laws in place that would require licenses for the collection agencies. Michigan is one such state.

You can look up the website of Secretary of State or the website of State Attorney General for the information.

Exemption for out-of-state collectors: Out-of-state collector are exempt if [1] collecting by interstate means; and [2] have no clients in the state of Michigan.

Seeing as they have an office in MI, they would need to be licensed, that is if attorneys are debt collectors under MI law thus require a license.
